Yes, include a costs assessment @£24 per hour. Go to town because this has not been allocated to a track. You will have to include a covering letter explaining DCB Legal's and Euro's modus operandi as operating as a bulk litigator with zero intention of going to a hearing, forcing defendants to submit witness statements unnecessarily, unreasonable behaviour etc. Print out 10 of the Euro discontinuances if you like.

Describe this as a vexatious claim and serial abuse of the court process. DCB Legal and Euro Car Parks literally never proceed to hearings in single PCN claims, and instead intimidate Defendants with pressurised, aggressive phone contact and putting people in fear of a CCJ. This wastes the time and money of the court and thousands of defendants across the country, week in, week out, and Euro Car Parks should answer for this repeated behaviour and they are long overdue to be questioned on it and sanctioned. State that this is proven abuse in litigation and wholly unreasonable conduct which means costs should be awarded on the indemnity basis.

The judge needs to be persuaded this is wholly unreasonable conduct.

You could link the DCB Legal discontinuances thread from MSE and point out that the 860+ recorded discontinuances are all proven with the Notices of Discontinuance image in every case so this isn't hearsay. This is a deliberate MO to use and abuse the court system and in this case they failed to even serve a Notice of Discontinuance to the Defendant.

As this is is one of ECP ticket not printing the whole registration but taking payment, can i mention that ECP have form for doing this as i have a similar case ongoing in another of there car parks?
