L999, absolutely. Many of us are already planning to do so.0

You can only claim very limited expenses. Which your day rate at a guess will be well above & is not what court would be looking at in terms of any loses.L999 said:I've read with interest, I received the same email responce from a junior investigator today at the FOS. I responded saying I wanted it escalated and gave a couple of reasons which seem to be omitted from the "cut and paste, santander response' (that Santander could have written themselves !
Does anyone have any thoughts on taking a claim to the County Court services "Money claims online"? .. for santander renaging on "Free forever" marketing claim for which we entered into when applying and the subsequent acceptance of our business and the opening of the account and then the 20+ years of our business ... and then the subsequent banks effective 'breach of contract" by imposing charges. With the amount being claimed as losses ... based on a (provable) day rate for the time involved in the matter and time to to switch to an alternative free business bank provider? ..

According to money claims online you can potentially charge for loss of earnings. In this case the time taken to resolve a matter by Santander breaching the free forever explicit marketing statement.. obviously took time to a) deal with Santander b) find an alternative free business banking provider c) the time involved in arranging, transferring, amending my paper work, billing systems, advise clients and suppliers etc... for myself easily "proveable".born_again said:

Small claims court due to Santander breaking their marketing promise? Definitely, and there's a chance you could "win" but have a think what outcome you want. No small claims court will (and I'd suggest can) force Santander to reverse their decision and remove the fee.L999 said:I've read with interest, I received the same email responce from a junior investigator today at the FOS. Small claims court to reclaim "loss of earnings" for the time taking to deal with the change? No chance of a win there I'm afraid.0 -
Yes, that's my approach, looks like the fee is currently £115, for upto 3k (I made a successful similar claim years ago related to time wasted with a mobile provider and won the claim). I take it that a) it'll cost more than the value of the claim I'll be making for santander to engage a legal team to respond b) if I win (over 70% of claimants win, and almost a certainly if your case is prepared well and santandar dont respond to the court), it has the potential for an avalanche of others to also claim losses. ... my prediction is they'll offer out of court and pay the compensation im applying for rather than risk a legal president being established...born_again said:

Money Claims Online/Small Claims do not set precedent - each case is looked at on its own merits (or lack thereof).L999 said:

From Sky News. Santander has a nett loss of almost 23,000 customers. Wonder how many are due to their conduct related to 'Free Forever' accounts they've done a Uturn on !
