Bury Smart Parking Fine - Same car park as usual

Options
Hello - aware of the copypaste to share for Smart Parking, but unfortunately I already submitted an appeal prior to seeing this.

I'd gotten a £100 parking charge because I seemed to have paid for a paybyphone parking meter entry rather than the one by Smart Parking. I have a feeling it was for the wrong meter.

I've sent an appeal reply with the evidenced item on the paybyphone app, and said "I have a valid evidence item from a PayByPhone record that indicated that I paid for the period in question."

Is it too late to be able to respond back with the POPLA message when I get further correspondence?

I suppose my wording could be implying that I as the keeper paid for the driver's parking, so may not be committing to the statement that I am a driver.

I presume then I'll have to just eat this cost?

That's not my presumption,  especially if the NTK PCN failed to comply with Pofa2012,  like other recent ones on here  ?

If I am being honest - I’m not greatly familiar with this information. In lay terms, what should I be responding with in this situation? Cheers

Firstly,  it depends if they complied with POFA or not,  so check your NTK PCN letter against the examples in the newbies sticky thread,  then tell us if it's fully compliant in timescales and wording,  or not   ?

But as you have already submitted your appeal,  and especially if you have revealed who was driving, it may be a lost cause do far,  if Smart Parking reject your appeal

Hopefully you did not imply or reveal who was driving,  especially if they failed to comply with Pofa   ?

    But that doesn't mean pay

Thanks both, but how should I approach a reply if they reject my appeal? If the POPLA bit doesn’t count anymore

Follow the advice in the newbies sticky thread in announcements,  don't bother appealing to the IAS, not based on the information so far. If you did the secondary appeal,  the IAS would likely conclude that the PCN was correctly issued

The approach is you ignore anything but a court claim.
