What is the likelihood of it going to court based on other cases? I want to be at least a bit mentally prepared as I know I’ll burst into tears trying to stand up for myself. I know logically they want to pressure people into paying the large amounts of money but it’s really stressing me out now I just want it gone

There are 836 reasons showing that they tend to discontinue the case before they have to pay the hearing fee are in the thread below by Umkomaas ( and remember that we are with you all the way. )

"now I’m panicking that they will have some sort of evidence if I forgot to change it"

    That's impossible.

They cannot obtain that evidence because under KADOE rules, the PPC was only allowed to ask the DVLA once per PCN.

That was at the time of those PCNs only. They have no idea since then which is why the sector Code makes a soft trace mandatory, and says (in a charlatan, self-serving roundabout way) that PCNs must be reissued if a new address is found.

    None of that happened.

If you moved home just before or after those dates (same year?) then it cannot be your fault. You cannot fairly be held to have immediately updated the V5C. Any reasonable person slowly works through broadband, council tax, banking, utilities, phone contracts and other address updates for a period of weeks or months after moving.

If you are sure you did change the V5C after moving and before that car was sold, simply say so in your WS.

You will get bombarded with DCB Legal young rookie graduate paralegals calls, desperately trying to scare you into settling. Ignore them.

Twiddle your thumbs until the hearing order arrives. It's 99% certain that this case will be discontinued anyway because DCB Legal don't like paying hearing fees.

Show us the NoD when they give up!

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you this is really reassuring and I’m so appreciative of all the advice. To date I’ve had 25 phone calls from DCB Legal (not answered) trying to pressure me to settle. I’m hoping it doesn’t get to court but if I’m the 1% that does at least I’m prepared with the help of you all on this forum

If it’s the same number being used, just block it on your phone. That stops the nuisance calls in their track!

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
