    That isn’t quite what the OP says. They say they were told no planning permission needed and then there was a suggestion of like for like. A statement that planning permission is not needed with no caveats, is not the same as saying you can have planning permission if you put the same thing back in again. 
    It may be the phrasing but the order of what was said, what  and when is going to be important here. 
    All shall be well, and all shall be well, and all manner of things shall be well.

    Pedant alert - it's could have, not could of.
