I rushed and sent an e-mail defence to ClaimResponses.CNBC@justice.gov.uk
I as worried about the time and sent it my e-mail at 16.45 tis is 28 days after service of notice having sent a AOS in time.
The charge is for not parking correctly in the bays.
I am worried that the time I sent it after 16.00 is too late, I also ned to know if my section 3 is ok, or what I need to do, maybe I need to go back and do it on the MCOL as abbreviated?
Also I need to know how/when to do or mention counter claim.
I am confused about the defence whether I say everything now including witnesses etc or if that is at the court case?
Ive read everything over the months bt with big gaps and I am now beyond deadline and really confused.
My section 3 was as below;

My section 3 was as below;
3. Referring to the POC: paragraph 1 is denied. The Defendant is not indebted to the Claimant. Paragraph 2 is denied. Whilst the Defendant is the registered keeper, paragraphs 3 and 4 are denied. The Defendant is not liable and has seen no evidence of a breach of prominent terms. The quantum is hugely exaggerated (no PCN can be £170 on private land) and there were no damages incurred whatsoever.
3.1 The defendant parked a wide bodied leisure vehicle to make a purchases totalling £100.07 in Aldi Supermarket and has the receipt and bank statement as well as other witnesses who were there on the day, who also have purchase history of that day.
3.2 The vehicle in question has a length of 6.12 meters and width including wing mirrors of 2.45 meters. There are no bays in this carpark designed for vehicles of this size which is inadequate and discriminatory for shoppers with vehicles that cannot fit the insufficient sized bays offered by this car park.
3.3 The defendant underline the fact that, unlike careless drivers who park cars inconsiderately and occupy more than one parking space completely unnecessarily, this was not true of the way in which the defendant parked on May 27, 2024.
3.4 If the defendant had tried to line up my motorhome in the centre of a parking space, the spaces on either side would have been impacted, thus rendering three parking spaces unusable for others.
3.5 The defendant parked considerately by straddling a line marking, thus only occupying two spaces and not three.
3.6 Cctv cameras operated by UK Parking Control Ltd at Bell Green will show that at the time the defendant parked responsibly there were many free parking spaces.
3.7 The fact that many parking spaces were available demonstrates that the defendant’s actions did not deprive other users of the opportunity to choose a wide variety of spaces.

Also now if I've said too much can I add more?
Will the e-mail be disregarded because sent after 16.00 and I just do the MCOL before midnight?
It is UK parking Control /DCB Legal
issue date 4 Jun
AOS sent and received on time

It wont be too late because the claimant wont have pressed the request judgment button, but do check that you received the auto email response from the CNBC in Northampton, in your inbox or spam folder , in which case it proves that they received it ( no need to submit on MCOL )
A counter claim is submitted with the defence, although few people have a good legal reason to counter claim anyway, plus a fee has to be paid too
The N180 stage is where you put down the likely number of witnesses
The WS stage in several months time is where you give your story and exhibits ( evidence )

I am so pleased you are here thank you!!
The auto response said1 -
also did I mess up with the number 3 I used the whole of the template and then 3 as mentioned above...0
-
Also did I mess up because I copied the whole defense to the e-mail body as well as attaching it.
Do I need to resend it, without it being in the body?0 -
It should not matter, keep checking your MCOL claim history every few days, checking when its been logged2

Also I would like to clarify I didn't break their rules by submitting the entire text of the defence in the body of the e-mail? The defence was literally the template but number 3 I adjusted as below;3. I am so sorry, I have spent hours and hours reading everything, but over a month ago.
Frazzled, time poor, poor and concerned.0 -
