Toyota say they can’t find any details of an agreement I had with them even though I sent a copy of the agreement I have in my file, they say because of data protection they can’t keep them too long! they now say that this is the matter closed but I have 30 days to contact the ombudsman. Should I?

    The ombudsman is closed for complaints regarding motor finance commission.  They won't accept it at this time.

    You need to be a bit more patient and wait for the court case outcomes and then the FCA consultation which will include what happens next and how it will be done.

    GDPR legally requires them to not hold data where a natural person can be identified any longer than is necessary. Breaches of GDPR in principle can result in fines of up to 4% of your global revenue (not profits) with no upper cap. 

    It's inevitable the FCA is going to have found many cases where data is simply no longer available and inevitably they will have to give guidance on what they expect to happen in those cases. The FCA have said they will put out a proposal within 6 weeks of the Supreme Court ruling and anticipate that if there is to be any redress that it will start in 2026.
