    Why 'must' you pay? Why not set them aside? How come claims are going to an old address?

    Why 'must' you pay? Why not set them aside? How come claims are going to an old address?
    Because unfortunately, due to moving and circumstances I missed the deadlines to challenge this and setting it aside costs more (£303) than simply paying it (£270)

    If the claim went to an old address you'd likely get that cost back, awarded against the Claimant.

    Ok, this is the full history of this particular 2nd claim, I actually did the AOS and then subsequently submit a defence for this claim using the advice in the newbies thread, but then during my house move I missed the directions questionairre and my defence was therefore struckout.

    Following advice here a soon as I became aware of this I emailed the CNBC and Group Nexus the day after my defence was struck out, with the following but had no response apart from Group Nexus emailing back to say they'd updated their system with my new address details - So I've just been waiting for someone to get back to me to let me know the next steps but I've heard nothing and now my only option given I missed the directions questionnaire and I'm getting no response to say I can resubmit seems to be to pay before tomorrow evening or I end up with a CCJ? Sure I could set it aside and challenge but I'm not sure it's worth the risk in this case, or more importantly the stress, I know this is how these people get you... the frustration I have is they seem to keep coming due to a cloned car and no one is doing anything at all - the crime reference number doesn't seem to matter, which is strange as if you are caught speeding by the police you do not get prosecuted as they can't prove it's you (happened to me and a colleague both found not guilty of speeding) (due to vehicle cloning). But somehow these private parking companies get away with doing this...

    Do I have any other options, do you think setting it aside is likely to result in success? I can just envisage the court siding with them saying they posted it in time and I didn't respond and that's the end of it.

    I am writing in relation to the above claim, for which I submitted a defence on 5th March 2025.

    Unfortunately, due to a recent house move and a known issue with mail regularly being misdelivered to a similar address (my former address was "redacted" and post was often sent to "redacted"), I did not receive either the Directions Questionnaire (dated 10 April) or the accompanying correspondence until just now. Although the tenancy at my new address began on 19th April, I did not receive any of the post as it was incorrectly delivered to the estate agents at redacted (the flat below mine), and I only recently recovered it — well after I had moved and updated my address with DVLA.

    As a result, I was entirely unaware that the claim had progressed further, and only became aware of the issue today after collecting the delayed post. I understand from my MCOL login that my defence has now been struck out on 25 June 2025, and I may now be at risk of a default judgment, through no fault of my own.

    Please find attached my completed N180 Directions Questionnaire, which I am submitting immediately in an attempt to comply as best I can despite the unfortunate delay.

    I sincerely hope that this can be taken into consideration. I had no intention of ignoring court deadlines and have acted promptly and in good faith upon becoming aware of the issue.

    I don't see you getting the application fee back. So no point fighting it as long as you pay by day 30.

    All you had to do was one email giving your new address, before you moved. So sad!

    I have paid the claim this morning and then just had a heated phone call with DCB legal after being on hold for 1 hour - after being on hold for a while they finally confirmed they received my payment but they have said they have not issued a judgment, however it is on MCOL. They say although they can see the MCOL version for some reason it's not showing on their records and they therefore cannot send me written confirmation that the debt is fully settled. I explained I must have this today, but they said a manager needs to review it and they will call me back, refusing to guarantee it will be today.

    I have to send the court proof of payment today to get this cancelled - I have an automated email from DCB' payment processor confirming the order. Will this be enough? Do I need to send a Form N443 – Application to Cancel Judgment: - or is this only if it's a CCJ past 30 days...?

    You don't have to send any forms.  Just send the court an email pointing out that it was settled before day 30 and thus the CCJ must be wiped. It will take until September to be removed but it will be.
