AS1 or TS1 when property already registered to the executor?

Why would you do this rather than sell it so the beneficiaries could actually benefit from their inheritance. Putting it in the beneficiaries name is asking for trouble. Frankly there was no need to put the property into your husbands name in the first place.0

Do the beneficiaries want to share ownership of the property or do they want to sell it?0

Thanks for your comments but please - I am not going to respond to questions about the nature of the property or the reasons for the changes in registered title - suffice to say there were/are good historical/current reasons for that.The question is a technical one on which form to use as most FAQs make the assumptions that either the property is still in the deceased name (AS1), or that the registered executor is now selling (TR1). Neither are true in this case.

Neither are true in this case.I would add a warning though, if any of these beneficiaries are not currently home owners they are going to get a nasty shock in how much tax they will have to pay when they buy their first home.0
