There are some people out there that will go to a main dealership for a quote and when they get the cash they then go to a backstreet garage for the repairs and/or just live with the damage and pocket the rest.Shez97 said:Thank you everyone for your advice and input. I understand, I guess because my intentions weren't that way inclined I wasn't really thinking of that but it is what it is.DullGreyGuy said:

Doesnt really matter if it were your intentions, legally they are obliged to pay you for the depreciation in value the car sustained at the moment of impact. Unless you try and actually sell it with the damage working out what the actual depreciation would be is difficult. As such it's been broadly accepted by the courts that the repair invoice is a reasonable proxy for the depreciation.Shez97 said:

You arent obliged to get the car repaired, you have still sustained an on paper loss because before the accident you had a car worth £10,000 say and now you have a car worth £8,000 because of the big dent in the side. If you keep the car at £8k and have £2k in the bank is the same as having the car repaired so restored to its £10k value and no cash in the bank.1 -
