No, you don't need evidence. The onus is on the other side to disprove your side of the story, if they decide to try. If it goes to county court what you say in your submission is regarded as the truth.the4amfriend said:Appreciate all your responses. What about the letter dated 2025 when their reply states that it was 2024? Doesn't that count as misleading? Is there anything I can do about that?2024 typo isn't of any importance.2 -

Is the vehicle registered at a Scottish address ?
Was the Smart parking pcn issued to a Scottish keeper ?
Have you divulged who was driving to Smart Parking or to anyone else ? ( hope not )

Yes, I'm in Scotland and the vehicle is registered at a Scottish address and the PCN was issued to a Scottish keeper. Unfortunately, I have divulged that I was driving. I've been reading the newbies thread, wish I'd read it before I appealed.1

Ignore this completely. Nothing will happen to you in Scotland, even though you've divulged who was driving. Single tickets are totally unviable to pursue north of the border, and Smart won't be going anywhere near it. Please show us this evidence (screenshots, redacting your data) because I think this could be important:I looked at the screenshots sent to me - their system says that the last email sent to me was on the 10th of Jan 2024 and their complaint response mentions the same but a screenshot of the letter shows that it was dated 10th of Jan 2025.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Below is the reply from Smart Parking's Complaints team and as you can see the letter was dated for a year ahead in time - I wonder how that could be a typo as these are usually computer generated?

Below is a screenshot from their 'system' that they sent over. Of course it matches what they have said so their reason would simply be that it was a typo but I don't trust them.
Either way, I've ignored the Debt recovery plus letters for now (got 2 in total), will look out for an actual court notice.1 -
