Item return advice

Good evening.

I bought an item on 5th April.
It arrived on 15th April.

I did not like the item and informed the seller and sent it back. I did not use the Returns process on ebay.

The item weighs 2 kilos and I used the same service that the seller used to return it on 26th April. Royal Mail flagged it as underpaid postage and left a note at the seller's address without any information where the item was coming from. The seller ignored it and eventually after I asked him what is happening to my refund, he deduced that it must have been my item and he went to the Delivery office.

He was told that the items is being returned. I waited and waited and the item never arrived. I complained to Royal Mail and the item was delivered back on Tuesday.

I checked the item on a scale and it was overweight by 65 grams!

Now, I would like to return the item to the seller and I have informed him but he has not responded. ebay's return window has also closed.

I will use a different courier with Tracking to send the item back.

Can the seller refuse to refund me after recieving the item? Advice would be greatly appreciated.

    Yes, seller can refuse as there isn’t a return case opened, they can simply either decline to accept the parcel, or if it is left, ask you to collect it or pay for it to be returned to you. 

    A change of mind return for a business seller is dependent on the return policy, which you have not met if the return window was closed. With hindsight you should have used the return system on eBay and ensured your item was weighed correctly, then as soon as item showed as delivered eBay would have expected them to refund you within 48 hours. 

    You are reliant now on the goodwill of the seller .

    In that case I suspect it means they aren’t interested in dealing with returns outside of eBay as a goodwill gesture.

    Might be worth trying to sell the item on instead to recover some of the costs.

    Did the seller offer a returns policy? Not sure why you posted the item without informing eBay, even if it had been delivered seller could simply have said it was an uninvited parcel. Probably good for you that you got the item back if it is not faulty.

    Did the seller offer a returns policy? Not sure why you posted the item without informing eBay, even if it had been delivered seller could simply have said it was an uninvited parcel. Probably good for you that you got the item back if it is not faulty.

    The problem with ebay's return is that you cannot use your own choice of courier and ebay also automatically create a returns label for you and charge you for returns which is more than what you paid if you used the same courier independently.

    Damn @£$£% seller seems to have also lied about the laptop he sold me : The screen was not 1920X1080 but a mere 1366 X 786 resolution and the keyboard is faulty with some buttons not working!

    If it's faulty then you can open a case and return it for a full refund. Only this time follow the correct procedure & don't just randomly post it back to the seller...

    Far too late to open any sort of case now on eBay, the lap top was bought several months back.
