Really need help with passport issue! Home Office asking for so much information!!

    Just a thought... 

    Did the documentation from the custody battle include anything that would serve as evidence of nationality?

    All the  background checks are part of Safeguarding  to prevent such thins as child abduction, trafficking.

    if the girl's mother is not cooperating to give information then it is her who is preventing her daughter from getting a passport.

    Does your wife have parental responsibility or just custody?

    Can someone born in the UK be denied British citizenship, if that leaves them with no nationality at all? I thought there were special rules in this case.

    Being born in the uk doesn't give you citizenship. You have the citizenship of the birth place of the parent

    I think this changed some years ago and the parent(s) had to be British citizens ( I certainly had to send our passport and state our places of birth for kids passports 30 years ago)  - or in certain other  specific categories - I think it is unusual for people to get British Citizenship without  the parent being a British citizen  at the time or having leave to remain etc etc hence the need to have all the proof in this case. 

    If the child was adopted by British parents then they become British. 

    The "they won't have any nationality if they are born" ie stateless case  is probably unusual as most foreign countries give citizenship to children born abroad to parents with citizenship of that country. They can get travel documents etc but it is complicated and need lots of proof that they haven't got citizenship of somewhere else through the parent

    Most countries in the world you dont get automatic citizenship just because you were born there. The US is one of the most notable exceptions and is the reason why some people intentionally go on holiday there during late pregnancy with the intent their kid will get US citizenship. 

    For most, if not all, you have the right of citizenship of your mother and potentially also your father. So realistically you are only looking at cases where the mother was stateless which is going to be unusual given most rules down allow you to make a person stateless (hence the arguments over Shamima Begum as the UK government stripped her of her British Citizenship on the argument she was also Pakistani by birth and so no left stateless by the removal)

    In this case, the girl's mother has another nationality and so our Home Office could argue that the girl has that as an option, and so the special rules do not apply.

    If you were born in the UK

    You do not automatically get British citizenship if you were born in the UK. It depends on when you were born and your parents’ circumstances. You need to check if you’re a British citizen.

    You may be eligible to apply for citizenship if you were born in the UK and are not automatically a British citizen

    Maybe. The embassy would of course require evidence that the mother was one of their citizens, evidence that might not be available. And of course the child would be subject to the visa requirements that apply to citizens of that country, meaning that the bureaucratic processes involved in a trip to Spain or Italy would be significant.
