    Nope it's irrelevant.

This parking charge is about the conduct of the driver on a certain day. The car they were driving doesn't matter.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi, received another LBC form from Moorside - this time it has a 30 day deadline to reply. Is this where i should now reply with the template reply? Starting to get nervy over all of this!

    Dear Sirs,

    Your Ref. ############

    Proposed Legal Proceedings

    Claimant: xxxxxx xxxxxxxx Ltd

I refer to your letter of claim.

I confirm that my address for service for the time being - assuming you don't faff about and delay any claim - is as follows, and any older address must be erased from your records:

    [Correct address here]

The alleged debt is disputed and any court proceedings will be vigorously defended.

I am sourcing and seeking independent debt advice and as such, I formally request that this matter be put on hold for an additional 30 days, in accordance with the Pre-Action Protocol for Debt Claims 2017 ('the PAP').

I note that the amount being claimed has increased by a hugely exaggerated amount which the Government called "extorting money from motorists".

Don't send me your usual blather about that.

I have two questions, and under the PAP I am entitled to specific answers:

    1. Am I to understand that the additional £70 represents what you lot dress up as a 'Debt Recovery' fee, and if so, is this nett or inclusive of VAT? If the latter, would you kindly explain why I am being asked to pay the operator’s VAT?

    2. With regard to the principal alleged PCN sum: Is this damages, or will it be pleaded as consideration for parking?

    Yours faithfully"

That's not the current recommended reply. Read post 2 of the NEWBIES thread.

Apologies, so this (filled in) should be my reply?
And i should not respond via the reply link, i should search through the forum to find an email address for Moorside legal?

    Dear Sirs,

    Your ref: [insert reference number]

    Proposed legal proceedings

Claimant: [insert name of parking company]

I refer to your letter of claim.

I confirm that my address for service for the time being is as follows, and any older address must be erased from your records:

    [Insert correct address here]

You should revert to your client because the 'propensity to pay' score in my case is zero, so any claim is hopeless and a waste of the court fee (whether 'fronted' by your firm or not). Move on to weaker victims.

The alleged 'debt' is disputed and any court proceedings will be vigorously defended.

    Yours faithfully,

You can briefly also state your reasons for disputing the claim and/or state (if true) it was so long ago you have no idea what it's about

    and/or (if true)

that you were not the driver and do not believe their client can hold the keeper liable.

I have replied to Moorside legal via email and have had the following response:

“We write in relation to the above matter.

The PCN was issued for Non Customer Parked in a Customer Only Car Park at Silverwing Retail Park 5/22/2025.

    See attached.

By entering and parking the vehicle on our clients private land you agreed to enter into a contract with our client and to be bound by the terms and conditions of that contract. The terms and conditions were clearly displayed. due to your failure to comply with the terms and conditions our client has issued the pcn.

We can confirm we hold the correct address.

In accordance with Schedule 4 of the Protection of Freedoms Act 2012, our client has the right to recover the parking charge from you as the registered keeper of the vehicle.

We ask that you make the full payment of £170.00 within 7 days of receipt of this email.

You can make payment in the following ways:

If you fail to respond or make payment, we may be instructed by our client to issue legal proceedings against you. This will incur further costs and fees that will be added to the outstanding balance. You may wish to seek independent legal advice.

    Yours sincerely,

    Moorside Legal”

They have also attached some documentsrion regarding the pcn.

Should i respond to this or continue with my ignoring??
