UKPS Parking Charge Notice

i have tried reading through a lot of the newbie posts but i am getting a little lost with all the information to be honest!
I went to visit a friend a couple of weeks ago and parked in the end of a small retail car park which until a few months ago had no cameras. Unknowingly to me they had been installed at and i now have a pcn.
i parked from 8pm - 9pm, do i stand a chance against this or cause i was not a genuine customer to the retail unit and cant provide proof i was do i have to pay? Any help is much appreciated

    What signage? I can see nothing in those photos, which scuppers their claim.

    There may have been elsewhere, but you'd need a sign to be in the images to adequately cover those 10+ bays, especially in front of the trees.

    All you can do is ignore though, because there is no genuine appeals process and the IAS is a kangaroo court.

    Keep that letter safe, ignore the powerless debt collection threatograms you'll receive and come back IF you receive a Letter of Claim from a solicitor (likely Gladstones, BW Legal or DCB Legal).

    Don't do it again though, just because multiple tickets are more court claim worthy.

    Well that's a non-POFA NTK (in date and wording) so they cannot hold the keeper liable.

    You could try an appeal and even roll out an IAS appeal (as keeper) for the LOLs and to cost UKPS money which might see them offer 'no contest' if you make it hard for them.

    The discount is irrelevant and you'll never pay it anyway. This isn't a fine. Just inform them if you move house.

    Up to you whether to just go into ignore mode or try the farce of appeal to try to flush it away.

    Sorry, what is a non-POFA NTK?
    why cant they hold the keep liable?

    i am going away for 2 weeks tomorrow, during which time the discount period ends. Do you believe I will definitely be fine ignoring this and end up paying nothing? If so I will forget about it until i return and go from there

    Sorry to quote again, but how do I approach carrying out an IAS appeal? May do this before i go in the hope as you said they just offer a no contest and that ends it.

    Re PCN number: 

    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

    There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.

    If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.

    If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.


    So this is the appeal i should start with?

    So I have received a Letter Before Claim as shown, no dates to reply by or anything though? I have read through some other threads on Moorside Legal trying to see the next step. A little confused from the threads I have read, should I reply with the pre-populated reply I have pasted below, or do I wait for the Letter Of Claim before responding with it?

    Any help much appreciated!!




    Reply to LBC as follows?

    Proposed Legal Proceedings
    Claimant: xxxxxx xxxxxxxx Ltd

    I refer to your letter of claim.

    I confirm that my address for service for the time being - assuming you don't faff about and delay any claim - is as follows, and any older address must be erased from your records:

    The alleged debt is disputed and any court proceedings will be vigorously defended.

    I am sourcing and seeking independent debt advice and as such, I formally request that this matter be put on hold for an additional 30 days, in accordance with the Pre-Action Protocol for Debt Claims 2017 ('the PAP').

    I note that the amount being claimed has increased by a hugely exaggerated amount which the Government called "extorting money from motorists".

    Don't send me your usual blather about that.
    I have two questions, and under the PAP I am entitled to specific answers:

    1. Am I to understand that the additional £70 represents what you lot dress up as a 'Debt Recovery' fee, and if so, is this nett or inclusive of VAT? If the latter, would you kindly explain why I am being asked to pay the operator’s VAT?

    2. With regard to the principal alleged PCN sum: Is this damages, or will it be pleaded as consideration for parking?
