    It sounds like one of those situations where it can work perfectly well if everyone is on the same wavelength, but can go wrong if one or two (or more!) neighbours are crap and say no.
    It looks to me to be a situation where those who are prepared to pitch in will end up paying everything, and those who just refuse to participate will get a free ride. Provided that most people are prepared to pitch in, it wouldn't be a huge problem. But if it becomes 'I'm not paying if they're not paying', then it could become a deadlock.

    I live on a private road, Cul de sac. Houses built in 1958. No management. No agreement.

    In the past, when it's needed work, we've either clubbed together, or as happened recently, one of the people on the road filled in the holes (he gets the stuff through his work), and we gave him a bottle of whisky.

    It's going to need resurfacing in the next year or two and it's estimated that it'll be a couple of thousand each. We've all already been told. I don't foresee any issues.
    Have you had any issues with mortgage lenders given the lack of maintenance enforcement?
    I'm the same, the road outside my house and both my neighbours is unadopted with no management and no agreement. One neighbour and the original owner of my house laid the road and pavement themselves in 1981. The bit I assume to be unadopted is barely 25 metres long and in good condition. My house has sold twice since it was built with no issues as has one of the neighbours.

    Isn't it a bit unusual for the covenants not to be transferred on?

    I live on a new build estate (well, was a new build 5 years ago) and the roads are due to be adopted but its a long long process.  Several houses have been sold on and the covenants have moved onto the new owners.  The developer is still responsible for the roads until adoption so we have reported issues to them and its been resolved.

    Has this been an issue for lenders? 
    It was never mentioned by anyone when i bought the house in 2023.
