    Name of court: Leave blank, CNBC or my Local Court?


    Claimant’s name (including ref.) 

    Defendant’s name (including ref.)

    including ref? The form already asks for Claim No. so what would these references be?


    5. How do you want to have this application dealt with? Hearing or Remote Hearing? The thread linked in NEWBIES by 123MrsT looks like it was remote?


    6. How long do you think the hearing will last? Do I add a time or just leave blank?

    Is this time estimate agreed by all parties? NO


    8. What level of Judge does your hearing need? District Judge or leave blank?


    10. What information will you be relying on, in support of your application?

    the attached witness statement ✔

    the statement of case ?

    the evidence set out in the box below ✔


    When it's time to email this to Applications.CNBC@justice.gov.uk, do I also cc DCB Legal, DCBL, ParkingEye?

    In Box 3 of the N244, I have added: 

    "An order (draft attached) that the judgment dated [DATE] be set aside. Due to lack of space, please see Box 10."

    Then in Box 10:

    "CONTINUED FROM POINT 3.

    1. The default judgment dated [DATE] be set aside.

    2. The claim is struck out pursuant to the reasons and principles in the binding Court of Appeal judgment in Vehicle Control Services Ltd v Carr [2025] EWCA Civ 713 (11 June 2025) and due to the POC failing to comply with Part 16, pursuant to Civil Enforcement v Chan and CPMS v Akande.

    3. The Claimant to pay the Defendants costs of this application of £303 on an indemnity basis."


    And then for question 5. How do you want to have this application dealt with? at a remote hearing

    Then in Box 10:

    "CONTINUED FROM POINT 5.

    The applicant is a litigant in person and would prefer the hearing to take place by telephone or video, if the court considers it appropriate."

    Or would selecting an in-person hearing from the outset be more suitable/appropriate?


    For the Claimant, the letter from DCBL states the Claimant as DCB Legal, but the POC states Claimant: PARKINGEYE LTD. 

    Which makes it confusing who should be added as the claimant and who should be served.


    Would this be correct?

    Claimant's name: Parkingeye Ltd

    9. Who should be served with this application? The Claimant & Claimant's solicitor

    Got a reply from DCB Legal asking for proof that I no longer resided at the property to which the claim form was sent, which I have just emailed to them.

    I’m assuming this is ok as they would receive that info as part of the N244 application anyway?
