    I have just received the following, is this when DCBL will discontinue or will they attend?

    Thank you!

    Single PCN case?

    Did the first judge's order say your costs were reserved?
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    @Coupon-mad Yes it's a single PCN.

    The first judge didn't really say anything, they basically ignored my Witness Statement and put it back to Defence saying that I would have to put in my Defence, which I did, then got to this stage.

    It's all got a bit confusing if I'm honest.  :#

    Also, as the claim has expired under the 4 month rule, why is it even still valid to even go to court?

    Because your first judge allowed it!

    You should have received his written order stating whether costs were reserved. If not, you will never get your £313 fee back.

    I thought lower courts were supposed to follow higher courts, i.e binding authority vcs v carr…

    I never received anything. The Judge just said I had 14 days to submit my Defence, which I did.

    Then received the letter I previously posted stating this was now a Defended claim, then heard nothing until this letter which states if struck out they’d be liable for my costs? I’m so confused now.

    You are definitely missing an Order from the judge, confirming the CCJ set aside and whether costs were reserved or not.

    Not sure what I can do about that, I definitely didn't receive one. The CCJ has been removed.  :|

    It wasn't obvious unfortunately. I thought it may have just been too late.

    I didn't type what to do because I expected you to just phone the court.
