    Yes send that if you want. Certainly reject their joke of a Draft Order. No rush though.

    Cc in your local court if the application has been allocated there now, because you don't want your judge fooled by their Draft Order.

    Sadly, some judges have fallen for Claimant Draft Orders so be ready for anything at the hearing.

    The entire Claim should be struck out as expired and all YOUR costs awarded, per the binding - your judge has no discretion - authority of good old VCS v Carr (thank you to VCS and to Jackson Yamba for that landmark case!)

    And if you want to be part of the push to change things in future, it's very important that people like you tell the Government that:

    a) you have no faith in POPLA or the IAS and that there must be the SINGLE APPEALS SERVICE that the Parking (Code of Practice) Act 2019 *almost* promised. As long as it is independent and impartial (and only ONE appeals service, not two involved in a race to the bottom) that will give a real option to resolve disputed cases out of court.

    b).  THAT THE ENRICHMENT OF 'DEBT RECOVERY FEES' MUST BE COMPLETELY BANNED. DISPUTED CASES ARE NOT SOLVED BY DEMANDING MORE MONEY AND OFFERING A 'PAYMENT PLAN', NOR BY SENDING LETTERS TO UNCHECKED OLD ADDRESSES AND ADDING A £70 REWARD FOR CAUSING CONSUMER HARM BY CCJs.

    c). Tell them about your experience and the complete and utter waste of court resources caused on a grand scale by DCB Legal,

    I'd wait until your case is allocated and you get a letter from the local court. If you hear nothing all month, chase up the CNBC.

    @Coupon-mad, just received this back from CNBC:

    "Thank you for your email and the attached application.

    I can confirm this has now been processed. The case has been transferred to the County Court of [PLACE], where it will be referred to the District Judge, who will draw the order in due course. Once we have received an outcome for this, we will be in touch to advise."

    So if I now respond to the email from DCB Legal declining their Order, I should just CC in the primary email for my local court? I assume I just add the case number to the subject so the court knows what the CC is about?

    Also, does this sound OK to you as a response to DCB Legal?

    Dear Sirs,

    I must respectfully disagree with your proposed order.

    You previously dismissed the evidence I submitted, yet you now indicate that you are willing to proceed with the Set Aside on the condition that I pay £412.44 (£123.00 Consent Order fee and £289.44 Judgment).

    It is evident that I did not receive the Claim Form, as I had already moved address prior to its issuance. Given that the Claim Form was served incorrectly and has now expired, I do not believe I should be liable for any associated fees.

    Furthermore, had my evidence been given proper consideration initially, I would not have been required to submit an N244 application at a personal cost of £313.

    Finally, as I have outlined in my Witness Statement and previous correspondence, had the Claimant undertaken due diligence and traced my address at the correct time, this matter would not have escalated to this point.

    I trust you will take these points into account.
