However, I am still confused about how they managed to get to CJJ without us receiving any court documents or letters regarding that individual.I see a charge of £123 for a submission.Jesus should have paid the fine!0 -

I've checked Experian, and there is a CCJ from March 2025. It is against another previous address, which was also a temporary residence as a student. Therefore, she wouldn't have received the paperwork at all0

Subject: Request for Consent to Set Aside Default Judgment – Case Reference: [XXXXXXXXX]
Dear Sir/Madam,
I am writing in reference to a County Court Judgment (CCJ) obtained against me by your client, UK Parking Control Ltd, under case reference [XXXXXXXXX], dated [insert date of judgment].
The judgment has to an address I vacated in XXXXXXXX I notified all relevant institutions after moving, and have not received any correspondence regarding this matter until recently when a High court wnforcement attendance visited anotrer prvious address of mine.
It is evident that no reasonable steps were taken to confirm my current address prior to the commencement of proceedings, which is contrary to CPR 6.9 (service at last known address) and CPR 13.2. Had any basic tracing exercise been undertaken, my current address would have been easily identified.
Moreover, the BPA Approved Operator Scheme Code of Practice (Version [insert version if known]) states at Clause 32.1(b):
“Before serving a Letter Before Claim and prior to the issue of proceedings, Operators must, if no responses have been received to the NTD/NTK/reminder letters, take reasonable endeavours to ensure that the person being written to is the correct party.”
I therefore request confirmation of what steps, if any, were taken to verify the accuracy of the address prior to issuing the claim.
I am seeking your consent to set aside the default judgment under CPR 13.2 on the basis that the claim was not properly served. Additionally, I request that UK Parking Control Ltd agree to cover the consent order application fee.
Please confirm your position in writing within 7 days of this letter. If I do not receive a response by [Insert Date – 7 days from today], I will proceed with a without-consent N244 application to set aside the judgment, at which point I will seek recovery of the £275 court fee as well as any further costs incurred, including for attendance at a court hearing.

So if her credit file has a linked address to yours then you(she) need to apply for a stay of writ
The fee is £15(ish)
Its fairly straightforward. Just dont panic.2
