Advice on dcblegal

Long story short, a family member has been hounded for a pcn on a sold vehicle. No evidence of sale and was a delay in notifying dvla. Said vehicle was also not registered by new owner. Have responded to lbc and requested 30 days PAP. This has been ignored and claim form issued a week later. Is this worth pursuing. Only hope as I see it is said vehicle was MOTd in buyers home town (10 miles away)the day after sale . The alleged claim is the vehicle being parked in the same town.

    Just follow the advice in the second post in the newbies sticky thread in announcements near the top of the forum by coupon mad and look at a dozen recent cases over the last 5 weeks,  doing the same thing as those victims are doing

    Is it really necessary to use whole of defence template as parts are implying actually being present which is not the case. Should they just explain not driver or keeper on relevant date?

    If (and it's a big if) buyers home address and details were provided prior to the commencement of the claim, that may be a complete defence.

    I'm guessing that this concerns events 5+ years ago. There is no absolute duty to comply with the protocol. There is a duty to issue a claim within 6 years.

    And use any template selectively. It's YOUR defence and it should only include matters which are correct (and that you understand). Any guidance in this forum is a exactly that - a guide, rather than tramlines that you must stay within.

    I agree, in this case: cut out much of the Template Defence and the relative could even put in a shorter defence on MCOL.

    Did the Defendant tell the PPC (and/or the DRA or solicitor who is now bringing the claim) that they sold the car? When did they tell them?

    I wouldn't worry, thinking that the relative's "only hope" is the new buyer getting an MOT in their town. No. Why so defeatist?

    There's EVERY hope of defeating pretty much any parking firm court claim and if it goes to a hearing their oral evidence will be the ONLY true witness to the fact of the matter: that they were neither the driver nor the keeper. No liability.

    Defendant spoke with claimant and bailffs from the start. The POC is pretty much what I’ve seen as standard DCB legal. Not sure how to post but 4 basic particulars and costs. Claimant is Parkmaven. Issue date is 20/5 , request for PAP 30 days was 12/5

    What is the Issue Date on your Claim Form?

    Who is the Claimant?

    Have you filed an Acknowledgment of Service?
    If so, upon what date did you do so?
    Your MCOL Claim History will have the definitive answer to that.
