    Burnt the midnight oil whilst grandkids slept. Have cross checked with original and hopefully not too many typos due to latetness when done. Copied and pasted amended defence word document into comment box however did not accept strikeouts and coloured fonts so have printed and attached photos.

    What 'comment box'?

    An amended defence doesn't go to the CNBC admin centre on MCOL. It goes to your local court.

    How just checked documentt - thought you meant I had typed "WITNESS" in capitals !!!! I will change to defence. Am forever getting the 2 mixed up

    Yes I've got the contact details. The N24 General Form of Judgement had my local courts correspondence had details on - I just need to verify email address. I will also copy claimants representative in. the email.

    Just in after long day out to find this waiting - am convinced they are out to get me but I won't give in despite the havoc it is playing on me and the thought of having to compile my WS with very little to support my defence due to the time scale since the alleged parking incident. Now need to start researching what it all means and looking for other similar posts. Does the initial response within 5 days of receiving the order include weekends or does it refer to 'working days"?

    I'm not too sure what is meant by point 2 on page 3 - I will take a quick look at CPR27 before retiring for the night.

    Recieved this morning by email from the sharks

    The "outstanding balance is £60" puzzles me when the POC states a claim of £284. They give me 7 days if I wish to settle!!

    1. Do they have to pay a court fee for "Dispute Resolution Hearing"?
    2. Am I correct in thinking my witness statement and any associated documents etc will need to be submitted by 18th May for hearing date on 1st June?

    I've read through a couple of posts on DRH. I'm not the most confident of people in oral situations and this scares me. I have no evidence, as such, except that I KNOW a pay by phone transaction was made following the provided instructions and a message was received back "no charge payable". This was accepted in good faith. I have followed all advice given.

    All the legal jargon throws me and the more I look into things the more confused and frustrated I get. I can dig my heels in too much at times.

    Left til the last minute in the hope that NOD would appear but now left with very little time to get my WS in. Monday is day 14 before the resolution hearing on June 1st

    Just wondering if Im going along the right lines. I may be trying to put too much detail in etc and am unsure. its my first rough draft, after reading several other threads. Never done anything like this before and have only my recall to go on. I know I need to number references/exhibits etc but am unsure how much more to put in. Scared of making it too 'flowery' and putting stuff which isn't relevant - and maybe annoy the judge depending on their mood!!!

    Apologies in advance for my ignorance - was so tempted by their offer of £60 settlement but heyho I'm a glutton for sleepless nights.

    1. Introduction

    1.1 I, [name], of [address], am the Defendant against whom this alleged claim is made. The facts below are true to the best of my belief and this account has been prepared based upon my own knowledge.

    1.2 I confirm I am the registered keeper of the vehicle and was the driver of the vehicle on the date of the event: XX June 2023.

    1.3 I am a litigant in person with no formal legal training. I have done my best to present my case and evidence clearly, and I respectfully ask the Court to take this into account.

    3. Response to the claim

    3.1 On the 24th April 2025 I received a Letter of Claim from DCB Legal in respect of an unpaid parking charge. It is my belief that every attempt was made to make the payment at the time of parking. On input of details a message was received saying “no charge payable” or words to that effect. Consequently no payment was processed.

    3.2 On the day of the alleged claim I was meeting my daughter and her husband for a meal to celebrate my daughter’s birthday. The restaurant, where we had booked, does not have it’s own carpark so I parked in the large carpark to the rear which was managed by Euro Car Park Ltd. My daughter had made me aware that 2 hours free parking was allowed and £1 payable for an additional hour. We did not expect to exceed the 2 hour time frame.

    3.3 I parked towards the back of the carpark , furthest from the entry point, so I could walk through the closest exit to the restaurant, I was limping badly, due to an ankle injury sustained the previous week, causing me to walk slower than usual. I had attended the hospital 24 hours early and diagnosed with possible tendonitis of the right foot. Exhibit screenshot of dated hospital visit and diagnosis

    3.4 I left the restaurant just after 2100hrs accompanied by my daughter and husband along with his parents. We walked back to where I was parked, when I realised I was just over the permitted free stay of 2 hours. I told my daughter I needed to get a ticket and went to my car to get my “parking change” purse out. My daughter said she would do it and I gave her the £1 coin.

    3.5 My daughter returned from the machine and said the machine did not accepted coins and a “pay by phone” transaction needed to be made. She said there were details of 2 parking apps on the machine and that she would sort the payment for me. She is very aware that I did not have any parking apps on my phone and am not always competent with the latest technology, especially when rushing and mistakes can be easily made. See 4.1 Digital exclusion

    Following the completion of the transaction, my daughter returned to say she had received a message back saying “no charge payable” or words to that effect. A screenshot/photo was taken of the response. Following this I drove out of the carpark.

    4 Digital Exclusion in Car Parks

    4.1 I was a victim of a mobile phone ‘WhatsApp’ financial scam in 2022 and since then have been extremely aware, and reluctant, to disclose any personal details, in particular any financial information online or via my phone. Exhibit ??

    4.2 Having experienced encounters in other car parks, where people have been having problems paying by phone, I have always avoided using these types of carparks unless accompanied by someone who can make the payment for me.

    5 Appeal

    5.1 Following the receipt of the Parking Charge Notice (PCN), dated 29/06/2023, I told my daughter and she responded that she would complete the online appeal form on my behalf, using my contact details. I had no objection to this. My daughter duly submitted the online appeals form stating the facts in respect of the payment of £1 for the subsequent hour, following the 2 hour free stay, and how a message was received back stating “no charge payable”

    5.3 Appeal Rejection. Email received from ECP 18/08/2023 Exhibit appeal rejection email

    Bullet point 3 under reasons for rejection state “as you did not purchase a pay and display ticket to cover the entire duration of your stay…..” no presented opportunity to purchase a ticket to display.

    Bullet point 4 under reasons for rejection “if unable to pay for your parking, you are required to seek alternative parking” I had no intention of parking for more than 2 hrs, which were free and no paid session required. On returning to the car and realising I was over the 2 hours - ‘the pay by phone’ payment was made, response “no payment required”.

    The email response included 2 pictures of signs/notices

    6 Signage

    6.1 I do not recall noticing any signs as I entered the carpark. There was just one entry/exit with no barrier or road markings. I did not notice any ANPR cameras or signage relating to them. Neither do I recall seeing any parking notices as I walked along the alleyway, between 2 buildings, to exit the far end of the carpark.

    6.2 On returning to the carpark later in the year it was clearly evident, by very visible notices/signs, that a new parking management company had taken over the contract. There was no evidence of any ECP signs/notices.

    7 Subsequent Action

    7.1 April of 2025 I received a ‘Letter of Claim’ from DCB Legal Ltd acting on behalf of their clients Euro Car Parks Ltd. From research I knew I was legally required to respond to a grossly inflated ‘debt’ of £170, which would rise if a claim was issued.
