    Not yet, they have until the end of the day to respond and I will be making formal complaints to BPA and DVLA at around 6pm this evening ;)

    When you complain to the DVLA, mention that you are not disputing that the operator had reasonable cause to request your data. It is the fact that their subsequent use of that data that is unlawful.

    The DVLA will fob-off with a boilerplate response and so you will need to raise it to Step 2 and eventually require an ICA submission.

    It would be worth examining whether, under the Railway Bylaws, ZZPS qualify as ‘Authorised Agents’ empowered to issue Penalty Notices on behalf of the train operator.

     24(3) – Identification of Authorised Persons

    This provision states:

    “An authorised person shall produce evidence of his authority at the request of any person to whom he issues a direction under these Byelaws.”

    SABA issued the Penalty Notice, so ZZPS have no authority to cancel it; and certainly no authority to lecture the RK about the actions of a driver.
