No you don't do that. WS stage is easy and you are nearly there. Even if you lost at the hearing it would be less than the claim.rose_valley1 said:Thanks for your input. Hope the claimant agrees at this late stage.I decided to follow your advice and go ahead with it. However, the trial is listed for 10 December. According to the court documents I received, the claimant must pay the trial fee of £27.00 by 12 November, otherwise the case will be struck out. They must also send me their witness statement by 26 November.
I am still waiting for their witness statement, as there is still time. I called the court helpline yesterday and today again to ask whether the claimant has paid the trial fee, and they told me they cannot see any payment on the system. They explained that either the claimant has not paid, or the court is dealing with a backlog and has not yet updated their records. They advised me to email the court with the subject line 'urgent', but the automatic reply says it may take up to 20 working days to get a response which would be after the trial date. So I doubt my query will actually be treated as urgent.
Given this, I am assuming the hearing will go ahead. I plan to send the court my witness statement, exhibits, and skeleton argument by post on Monday (24th), and I will email the same documents to the claimant on 26th.
I was also wondering if you know of any alternative way to confirm whether the claimant has paid the trial fee, or whether it’s common for the court to delay updating trial fee payments on their system.

Its definitely common for a court to be a week or two behind
You did the correct thing in contacting your local civil court and checking, so you could check again on Friday or early next week
Seems to me that they may have discontinued if you have not received their trial bundle yet
Check your email inbox and spam folders for their N279 discontinuation document
