We write to you in relation to your complaint received on 11/05/2025 regarding the above finance agreement starting on or around 20/12/2006.

Your Complaint

You’ve stated the Financial Conduct Authority (the FCA) launched an investigation into unfair historical motor finance arrangements on 11 January 2024. This has led you to believe that you may have been affected by these practices. You’ve asked us to investigate if your finance agreement with us had any form of Discretionary Commission Arrangement (DCA) between us and the broker/car dealer or other entity.  You’ve said that if there was a DCA in place, we should treat your communication as a complaint. 

Findings of my investigation

After reviewing your case, I have found the following:

·         On 6th April 2007, the Financial Ombudsman Service (FOS) commenced jurisdiction of the Consumer Credit Act 2006. As your credit agreement started before this, we can confirm it out of scope of the Financial Conduct Authority review launched on 11th January 2024.

Outcome

Given the above findings, we believe we have acted fairly and reasonably, so we are unable to uphold your complaint. We will now close your Customer Relations case.

What we need to tell you

Data Subject Access Request (DSAR) under the Data Protection Act 2018 / GDPR

If you have raised a DSAR to find out whether your agreement(s) had any form of DCA, we have made a reasonable and proportionate search to identify and retrieve the information which you have requested.

If you are not satisfied with our response to your DSAR, please let us know.     The agreement is outside the scope of the current review. Be no grounds to pursue the matter further,

    They are correct, your agreement was too long ago for a DCA claim.
