Cumbria Parking Services: Failed to make payment that covered the entire duration of your stay

In October 2024, a PCN was issued by CPS to the vehicle driver having parked at A591, Ambleside in the Lake District. The breach was because the driver paid for 2 hours but lasted 2:39 in the car park.

As the keeper, I've now received a Letter of Claim from BW Legal, and I've just responded to it using the template provided in the Newbies section. I've emailed it to disputeresolution@bwlegal.co.uk. I believe that's all I need to do and wait for them to take further action, is that right?

    Hi @Coupon-mad, apologies for the very late response, but here is the letter as requested. I've not heard from them yet.

    Below is a copy of my last correspondence from them in May:

    I can see that you are contacting us today about an account with Cumbria Parking Services Ltd, where the outstanding balance is £170.00. This balance is in relation to a Parking Charge Notice (PCN) issued under PCN number XXX. The vehicle bearing registration XXX was parked in breach of the terms and conditions at A591 Ambleside LA229SE on XXX. The terms and conditions displayed at the site offered the driver a contractual license, which was accepted by the driver upon entry, and subsequently breached for the following reason: Failed To Make A Payment That Covered The Entire Duration Of Your Stay.

     

    Please note you were made aware that you would be liable for additional costs if the original PCN was not paid. In respect of the contents of your correspondence, it is apparent that a large amount of the information contained therein has simply been ‘copied and pasted’ from an external source, which we see on a regular basis. Large portions of your letter are irrelevant to the claim and therefore nonsensical, and therefore unreasonable.

     

    We have placed the account on hold for 30 days to allow sufficient time for you to seek independent legal advice regarding this account. Should you require any further information regarding the matter, please do not hesitate to contact us.

    Show us the two dates on that hybrid NTK.

    Only giving you 14 days is against the Code of Practice, if that was the first postal notice after a supposed windscreen PCN.

    It was an ANPR so there was no windscreen PCN issued. This letter was the first correspondence I received which suggested an earlier one was sent by post which I never received. Here's the NTK with dates shown.

    BTW, I've seen the appeal for responding to the government consultation and I will aim to respond to that ASAP.

    They are saying there was a windscreen PCN issued 'to the vehicle' but I assume that's a lie and neither photo backs that up?

    From the angles of the photos does it look like ANPR or CCTV up on a pole took the images, or a person on foot. Loitering?

    Could you show us the back?

    This is a non-POFA notice as they've pretended a windscreen PCN was issued which is impossible with ANPR!
