    Add that you require them to confirm this has been done by the end of next week at the latest or you will defend and counterclaim for damages for distress and data misuse.
    This! Until you get confirmation from DCB and more importantly the court that the claim has been cancelled, then it is still live and you must deal with it as such. A pain, yes. At least do the AOS so you have time, hopefully sufficient for DCB to do their thing and formally withdraw the claim.

    Hi all, I'm keeping this plate spinning as I've received no confirmation that it has been cancelled. I've edited the defence template and my particular defence is in bold and italics.

    DEFENCE

     

    1.  The Defendant denies that the Claimant is entitled to relief in the sum claimed, or at all.  It is denied that any conduct by the driver was in breach of any term.  Further, it is denied that this Claimant (understood to have a bare licence as agents) has standing to sue or form contracts in their own name.  Liability is denied, whether or not the Claimant is claiming 'keeper liability', which is unclear from the boilerplate text in the Particulars of Claim ('the POC').

     

    The facts known to the Defendant:

    2. The facts in this defence come from the Defendant's own knowledge and honest belief.  Conversely, the Claimant sets out a cut-and-paste incoherent and sparse statement of case. The POC appear to be in breach of CPR 16.4, 16PD3 and 16PD7, and fail to "state all facts necessary for the purpose of formulating a complete cause of action". The Defendant is unable, on the basis of the POC, to understand with certainty what case, allegation(s) and what heads of cost are being pursued, making it difficult to respond. However, the vehicle is NOT recognised by the Defendant and it is admitted that the Defendant is NOT the registered keeper.

    3. To support this evidence the Defendant has a written statement from the DVLA confirming that the Defendant's (current and previous) address(es) are not recorded under the current or previous keeper details.

    The Defendant has subsequently received an email dated May 22, 2025, from the Claimant stating: ‘Upon review, I can confirm that the parking charge:  xxxxx issued to vehicle xxxx has already been cancelled today. 
     
    We have also requested the cancellation of the charge with debt recovery, DCBL and ZZPS Limited.
     
    As the parking charge has been cancelled, it has reached the end of its lifecycle, and the case has now been closed.
