Unfortunately, dad received a letter ordering that the claim will be heard on 10 February 2026. He is now super anxious, as I've told him most likely we will not have to go to court, as DCB legal discontinues cases before it goes to court. He's also working on that date and will not be able to get the day off as he's running a business.
Is there still a chance DCB will discontinue by the hearing date, or is it done now, the hearing will definitely happen? Also, if they were to discontinue, how can I find out, is the only way to go to the hearing and see if they show up?

They will discontinue before the date they have to pay the hearing fee. I thought you knew this, having read these 740 examples:

If the claim is for around £300, they will discontinue just before the hearing fee is due to be paid by them
When is the hearing fee deadline. ?
The hearing cannot happen if that fee isnt paid, no fee, no court
DCB Legal will email their N279 discontinuation document to the defendant before the hearing fee date , so always check the email inbox and spam folders for it
After the hearing fee deadline date, the defendant can phone the court to see if they paid the hearing fee, but its more likely that their N279 email arrives beforehand2 -

Ahh okay, good to know! I was just following the template and newbie FAQ and don't remember reading they'll discontinue before paying the hearing fee. Yes, it is around £300. The hearing fee deadline is 4pm on the 13th January 2026 - fee of £27. I will keep an eye out for emails. No it is not, the N180 was filled out in July 2025 and was asked for dates in the next 3 months.Le_Kirk said:
