You need to flesh out - before POPLA - if this is a VRM typo case or if they are saying that the driver did pay for the right VRM but overstayed.0 -

You need to flesh out - before POPLA - if this is a VRM typo case or if they are saying that the driver did pay for the right VRM but overstayed. They have rejected my appeal on the basis that they confirm the contravention of insufficient paid time against the vehicle, but cheekily have offered to extended the ‘discount’ price. They have said the vehicle remained on site for 13 minutes over. They say signage clearly informs motorists that they are required to purchase tickets for the full duration. They wish to confirm that the car park is operated by ANPR which captured the vehicle entering and exiting. The information is then paired with information on the payment machine. They say the PC has been issued correctly and if I wish to appeal this independently I can contact IAS?What action do you recommend I further take?
Thank you0 -
Ignore them as they've moved to the IPC so POPLA is no longer on offer from Smart.
We assume you've been reading recent Smart threads and saw that thread? Have a look.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Did you do the appeal in your MIL name
Did they in the first or so paragraph give you the chance to name the driver

Ok so on Day 1 - send an email to COD@smartingparking.com (as the MIL) naming you as the driver giving name and home address
Save and print the email into a PDF
Take a photo of the letter from Smart
Day 2 appeal to the IAS - state your not liable as the keeper since liability as per the letter from Smart has been transferred and you evidence it by the email attached etc etc
Come back and let us know what happens.2 -

Next day, MIL appeals to IAS stating she is not the driver as keeper(orginal letter?) And attach day1 email?
Really appreciate all the help.0 -
So the appeal to the IAS is that keeper liability has been discharged as the driver has been named (evidenced)2
