Shapermint returns

Hi All,
I am currently trying to return unsuitable items to Shapermint but am being told I cannot receive a full refund and part of the return will be given in a gift card. I do not want a gift card and I have told them in not uncertain terms that I will not shop with them again.
Also have copied and pasted the 14 day distance selling rules repeatedly.
Has anyone else had issues with Shapermint?

This is the response I have had:"I've checked your order and I can see that the item _**The Classic Shapermint Essentials High-Waist Shaping Capri*_ was purchased on Clearance/Final Sale. Items or products that are tagged as Final Sale are not included in our Shapermint’s FREE exchanges and EASY returns policy which means it is not eligible for return, and can only be exchanged once."
Surely this does not affect my legal rights?, as in:Under UK distance selling regulations, consumers have the right to return goods purchased online, by mail, or phone for a full refund, even if there's no fault, for a limited time. This right is often called the "cooling-off period" or "right to cancel". Consumers typically have 14 days from receiving the goods to notify the seller of their cancellation and another 14 days to return the goods.0 -

Their terms state the governing law is California, so you would need to check what rights you have under California legislation.UK consumer rights won’t apply. You need to do your homework on companies before purchasing.2

Just as an aside to this. Did you go for the Priority Shipping? A lot of people are reporting being scammed by this company, apparently if you select the priority sipping you are automatically made a member and your card is charged monthly.1

Products marked as Final Sale cannot be returned or exchanged
Probably completely legal in California.
