It's stamdard legal speak put on all such letters - It does not mean that they are actually considering further action.

Translated it says "In our opinion if we should later decide to take action you can't use the fact that you have paid the money back as a defence".

However that is only their opinion and if it does come to further action then you will no doubt have a different opinion.

If it gets as far as appeal or even prosecution then it's the judges opinion that matters.

Thank you for your response. I thought it was something along those lines but wanted some clarification.

I thought it might have meant the Council gave made “their” decision on Overpayment of HB / CTR etc but if that might not be the end if it if there’s also an income-related benefit in payment that’s ignorant to the current Capital. 

OP does your Dad receive Pension Credit?

No, he doesn't have pension credit.
