Newbuild Land Dispute Planning Enforcement

    What would be the best approach to stop them from enforcing this and making us take the shed etc down. Nothing we have done hinders the SUDS and all they keep saying is that we are using the land as an extension to our garden which is a change of use. - devastated ..

    TBH I'm not sure I understand how you can put things in the SUDS area and it not impacting on the effectiveness of the SUDS... it might be this which is causing the issue for the planners.

    What kind of SUDS is it?  Would you be Ok posting a picture?

    When a planning authority threatens enforcement then often it is better to comply first and then argue about it later, unless the cost of the development (and removal) is considerable.  You might be better off engaging a planning consultant (with a specialism in appeals) to take on the council.  Alternatively, do as the council wants and submit an application, then appeal if the decision does go against you.

    Picture 1 is the shed we have since added a greenhouse, picture 2 is the full SUDS, we have taken the fence down on the right as it didn't go all the way down as picture 3 is the direct access from our front garden as the fence stops before it becomes a full enclosure.

    Picture 4 shows the small fence which we replaced with a full height fence which the builders solicitor agreed to as he wrote the TP1.

    Did you check if you required planning permssion to replace the low fence with a high fence within that distance of the highway?

    Hi the builders solicitor said we didn't need it as it was within our domestic curtilage and it was a continuation of exactly the same fence and dimensions which you can't see out of picture that also runs along the path edge

    everything we have done was ran past the builders solicitor before purchase who confirmed all was ok to do

    Ah, so it was only the dog-leg piece of fence leading up to your house, and not the one parallel to the highway, that you've replaced?
