    Smart have just jumped ship to the IPC and POPLA is no longer available for charges issued under their IPC membership, but it will also depend on what is on the signage and Notices to Keeper.

    If their notice stated you could appeal to POPLA, then that's what you should be given access to.

    If their paperwork and notices clearly show they are now IPC members and offered the IAS then you do nothing, the IAS is not worth your while because you will likely lose that appeal.

    But I would be willing to bet their signs still show them as BPA members which will not help their case.

    Sorry you can't, and you can't access POPLA.

    We've seen this before: when parking firms jump ship to the other trade body, people's cases fall down the crack in between.

    The BPA no longer have any clout over Smart Parking. You can't complain to them.

    Sit tight, keep ALL paperwork, ignore the £160/£170 threatograms and tell Smart & their agents if you move house. That's it.

    DO NOT PAY.

    Come back when you reach LBC stage, like the poster whose thread is next to yours right now (DCB Legal).

    They can’t just decide to jump ship after issuing a notice as a ‘BPA approved member’ and stating that I can appeal to POPLA in their initial notices. 

    I have 7 notices. 

    This is a living nightmare!

    I have appealed to SP directly. I will be complaining to BPA as they issued the notice as a BPA member. I will be taking this to the landowner and my MP too. 

    I am a solicitor, so I cannot afford for this to go to court and risk it affecting my practising certificate. 

    They are ruthless bullies and deserve to be taken down.

    Surely £140 (£20 each) for 7 charges is far more economical than spending how ever long fighting them (the equivalent of half an hours work for some solicitors).

    They have not all been reduced. I agree it would be a simple and time efficient solution. Time and money aside though, this company needs fighting on principle.

    They are taking advantage of many vulnerable but also ordinary people and I commend the MSE forum members on here for the work they are doing to help.

    I am not clear Kaizen what you mean by not being transparent? I provided the requested evidence of being a gym user and this has been ignored by SP, hence the rejection. 

    I will not be appealing to IAS. Thanks.

    It doesn't even risk a CCJ if you follow our advice, and certainly not your practising certificate. You don't get a CCJ.

    They can - and have - jumped ship.

    @Kaizen2024 is a poster who represents the parking industry (self confessed) which is why he's telling you to pay and throwing in some consumer blame, wrongly accusing you of not being transparent.

    My advice stands.

    You are NOT risking a CCJ.
