    Hi all,

    brief update and query

    the deadline I provided to Moorside expired on 9th May and I submitted my N244 to the court on the 13th May.

    They are currently reporting a turn around time of 4 weeks for this to make its way to a judge, so a couple weeks to go.

    In the meantime, Moorside have responded in the last couple days as follows:
    To confirm this matter relates to 3 Parking Charge Notices issued from xxx to xxx for being parked without clearly displaying a valid PCM UK permit at xxx (note: this is the correct address where I lived when PCNs were issued). A County Court Judgment was issued on 14 March 2025. 

    A Letter of Claim was sent to you on 9 September 2024 at xxxx. (note: this is nearly my previous address but wrong again - it refers to my next door neighbours address and not the address it was incorrectly served to - i dont think this actually matters) 

    We believe the Claim was served correctly at your last known address. 

    To enable us to fully consider your position, we ask that you provide proof of your address at the time the Claim was issued on xxx. 

    Further, you have failed to provide details of your potential defence to the Claim. 

    At this stage, we remain instructed to seek repayment for the Judgment. 

    Should you make an application to set Judgment aside, we may be instructed to oppose the same. If you decide to pay the Judgment, we may be instructed to neither consent nor oppose your application. 

    You may wish to seek independent legal advice. 

    Do I, a) do nothing and let the court proceedings go ahead 
    b) provide address as requested and look to get this set aside?

    either way, I will not be providing a defence. this seems obvious!

    Presumably your exhibits with your N244 already include proof of that? You should have done.

    I'd send Moorside this email proof that their client was informed on date/year:
    They did respond to my email regarding change of address, but failed to acknowledge that key bit of info. However, their response was via email (so acceptance) also, they continued to post letters to old address.

    You are right: you do not need to (yet, maybe nit at all) defend a case where the Particulars of Claim probably don't even specify three dates of breach, let alone what that breach/conduct was!

    i have done both of the above - no response. I called them up and they had decided they were happy for me to proceed with my set aside claim or words to that effect. They hadn't previously communicated this.

    Regardless, after 8 weeks, I have been allocated a judge and a local court. But no date yet.

    The court has sent me a print out of most of my submitted evidence - but not all. I will be contacting them to make sure both me and more importantly, the C, have received completed packs of submitted evidence. Don't want any additional delays.

    i've just checked my Draft Order.

    i had struggled with what to put in order to get my costs back and decided I would research further later... I didn't... and submitted requesting "no order as to costs"

    given I have a judge, but no date, can I amend? How do I go about doing this? resubmit to the CNBC? Again, I dont want any delays

    Resubmit a fresh Draft Order with a Skeleton Argument, to the LOCAL Court asap.
