Sainsbury's Parking - Euro Car Parks PCN

Hi everyone.
I would appreciate some advice please.
Two weeks ago I parked at a Sainsbury's supermarket for precisely 1 hour and 2 minutes. Yesterday I received a PCN from Euro Car Parks saying that I parked on private land without authorisation.
I was under the impression that I have 3 hours of free parking like the Sainsbury's in my home town so I was surprised to receive this PCN.
I intend to appeal but wanted to be sure I follow the tried and tested process.
I have been through the Newbie board but am not sure which is the correct process in this instance.
Your advice is much appreciated.

You cannot assume anything with parking these days it's become a bandits paradise each car park has it's own T&C's.
You say the PCN states "parked on private land without authorisation" that does not suggest an over stay, it suggests parking in a no parking area or out of hours, we would need further details.
But in the meantime there is an appeal in the newbies thread already written for you, it won’t get it cancelled as you are dealing with scammers cancelling isn't profitable.
Plan A should be your first step.
But if you were parked without authorisation you did not enter into a contract and they cannot issue a parking charge where no contract exists, you were trespassing.

Never assume anything,  that is the first rule

Each car park will generally have time limits,  not necessarily one size fits all

In Manchester each Morrissons car park has its own limits, or not, some are the typical 3 hours,  at least one is 3 hours during the day and no limits overnight , Aldi and Lidl tend to be 90 minutes,  some Iceland require vrm registration inside the building,  etc

It definitely appears that the vehicle was parked in the wrong place or more likely,  when the business was closed

    Thanks everyone.
I called the Sainsbury store and apparently they have a 30min free parking and then a receipt of shopping has to be approved in store. So that's the reason for the PCN.

I don't think complaining to Sainsbury will cancel this PCN. Is there a text I can use to appeal to Euro CP? Don't they have to prove the driver? obviously I am not going to identify myself as the driver.

Complain anyway,  especially if you were shopping and provide copies of receipts or statements etc

The blue text template appeal is in the newbies sticky thread in announcements near the top of the forum,  have you read it   ?

If ECP complied with the law named POFA 2012, then no they don't have to prove who the driver was,  they simply transfer the liability to the keeper

It will. Escalate the complaint to the manager and persist, because there's no real 'appeal'.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Well, if it took a phone call to them to garner this information that suggests to me that the signage isn't clear.

    Thanks. Do you mean this?

    Re PCN number:

I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.

If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.

If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.

Yes that is the appeal template,  although they wont cancel the PCN,  so expect a rejection

You won't find complaint examples in the newbies sticky thread,  you will find examples in the Successful Complaints thread in announcements,  so a dedicated complaints thread, where many complaints have worked
