Thanks Coupon-mad, should I go ahead with the set aside on MCOL ? if so what do I write, quick outline of situation or is there a template on here somewhere? Also do I need to contact DCBL and tell them what is going on ?

HMCTs emailed.
I have been reading threads all weekend and I am still not sure what exactly to do, all of the threads seem to be general 'not received anything before CCJ' Where as I did, then didn't then did again !
Do I just patiently wait for the outcome of the CNBC investigation? or go ahead with the N244. ? I don't suppose waiting will make much different to the CCJ as its over a month since the judgement.
I'm sorry if it all seems quite obvious, but I'm finding this all quite stressful.

after submitting the AOS I waited and as expected DCB legal sent me a DQ before Northampton. Then nothing no further forms or correspondence, I will admit I completely forgot about it. Then this morning I receive a notice of debt recovery for my unpaid CCJ from DCBL. (£314)
Went stright onto MCOL and this is what was on the system.
I rang Northampton and they told me that the DQ was sent to my old address. Even though all previous correspondence has been to the correct address (once DCB legal found my address as per beginning of thread) I checked the MCOL all correct AOS correct so I am a bit confused as to why the important stuff ie, the DQ went to the old address. (I have a copy of the orginial claim form from Euro carpoarks which has the correct address.)
As well as emailing HMCTS have you also emailed a complaint to the CNBC? Both?If yes, wait and see what they reply with in March because you need clarity: how on earth did they get your old address?!

I haven't emailed the CNBC because I made it quite clear on the phone that I wasn't at all happy with the situation hence their internal investigation. I will though, first thing.
I am expecting that DCBL will be contacting me again soon with another notice of debt recovery, should I make any effort to contact them or just ignore them?
Once I have more information from the CNBC I will go ahead with the N244, am I correct in going down the CPR 13.3 discretionary set aside seeing as I did complete the AOS and intended to file a defence but failed due to some (unknown) procedural error.
I am also quite aware from reading a lot of the threads on here that the courts like a 'prompt' response in regards to the N244 which is looking like it might not be if I have to wait on the CNBC.
Very tempted to set several reminders on my phone to chase CNBC/HMCTS…… don't have much faith in a timely response !

A phone call is not worth the paper its not written on ( everything in writing, no assumptions. )
