AOS done, I have a few nights shifts this week so plan to sit down at the weekend when my head isn’t as pickled. My defence is that the car was taken with out my knowledge, I was not in the country and therefore did not enter into any “contract” would this be acceptable?0

An update, after submitting the AOS I waited and as expected DCB legal sent me a DQ before Northampton. Then nothing no further forms or correspondence, I will admit I completely forgot about it. Then this morning I receive a notice of debt recovery for my unpaid CCJ from DCBL. (£314)
Went stright onto MCOL and this is what was on the system.
I rang Northampton and they told me that the DQ was sent to my old address. Even though all previous correspondence has been to the correct address (once DCB legal found my address as per beginning of thread) I checked the MCOL all correct AOS correct so I am a bit confused as to why the important stuff ie, the DQ went to the old address. (I have a copy of the orginial claim form from Euro carpoarks which has the correct address.)
I am assuming that I now need to complete a set aside on MCOL, any advice as to where I should go from here would be greatly appreciated. Is the set aside the right way to go ? the nice man from Northampton said I would need to fill in a N244 is this correct ? is there some guidance on the forum regarding the set aside ?

You should have been checking your MCOL claim history regularly, because you would have sorted this out months ago, you took your eye off the ball and they scored an open goal
Email a complaint about it to HMCTS regarding the CNBC sending paperwork to your old postal address
Wait for replies regarding what else to do about it

Is your Government Gateway account showing your old address? Happened to someone in January. They had unknowingly overwritten the correct address with their old address by using a rarely used Gateway Account with incorrect address info in it.PRIVATE 'PCN'? Checked the Gov gateway account which was correct. I have had an email back from the CNBC to say they could not confirm whether the change of address was due to a court error, so administrative officer has raised a query for investigation which could take 3 to 4 weeks. Which isn't ideal. I could do with some advice as to what quite to do now. I understand this may not be something that resolves quickly.

Yep email first thing tomorrow, a formal complaint about it to HMCTS.
They will give the CNBC a kick within 2 weeks.
