DCBL / DCB Legal (ongoing for 9 months)

Hi everyone,

Brief/concise summary:

July 2024 - PCN from Parking Group (The Parking People)
August 2024 - Appeal submitted (Parking Group Website) - screenshot saved as proof of submission

HEARD NOTHING BACK

October 2024 - Letter from DCBL
October 2024 - Letter sent to the Parking People informing them that my appeal received no response and that they had denied me having my appeal heard by POPLA.  I asked for a new appeal rejection letter and a POPLA code.

HEARD NOTHING BACK

April 2025 (6 months later) I received a letter from DCB Legal (not DCBL this time) asking for payment while sounding as threatening as possible.

I have saved my appeal I submitted and also my letter to the Parking People in forming them they had denied me the opportunity of appeal to POPLA and asking for a POPLA code to be issued to me.   

I have not contacted DCBL as I was advised not to and only contact the Parking People which I have done but never get a response.  Do I contact DCB Legal and explain my situation?  I have read that ignoring DCBL is the way to go but do I have to act on DCB Legal?

    Correct but only when you get a Letter of Claim. See 2nd post of the Newbies thread.

    Show us the PCN, both sides, and tell us what went wrong to cause the PCN?

  • Here is the PCN from the Parking People.

    I have also attached the image showing the signage was not visible from my direction of travel. 

    My most recent letter received this week IS FROM DCB LEGAL and says "LETTER OF CLAIM"

    How should I proceed?

     
  • The Letter of Claim offers a "dispute resolution call"  Do I ring and go through the timeline (in my first post) and explain I have copies of all correspondence sent (without reply) and explain the lack of clear signage (photo evidence)

    Just send what the NEWBIES thread second post already tells everyone to email at LBC stage.

  • Ok - I have trawled through the posts.  Is this the letter I send to DCB Legal in response to their "Letter Of Claim"?    And in here I raise the fact I have complained to the Parking People due to non visable signage on entry?  (using their online form and got no response so was denied having my appeal heard by POPLA)

    I refer to your your letter of claim.

    I confirm that my address for service for the time being - assuming you don't faff about and delay any claim - is as follows, and any older address must be erased from your records:

    The alleged debt is disputed and any court proceedings will be vigorously defended.

    I am sourcing and seeking independent debt advice and as such, I formally request that this matter be put on hold for an additional 30 days, in accordance with the Pre-Action Protocol for Debt Claims 2017 ('the PAP').

    I note that the amount being claimed has increased by a hugely exaggerated amount which the Government called "extorting money from motorists".

    Don't send me your usual blather about that.
    I have two questions, and under the PAP I am entitled to specific answers:

    1. Am I to understand that the additional £70 represents what you lot dress up as a 'Debt Recovery' fee, and if so, is this nett or inclusive of VAT? If the latter, would you kindly explain why I am being asked to pay the operator’s VAT?

    2. With regard to the principal alleged PCN sum: Is this damages, or will it be pleaded as consideration for parking?
