PCN from 2023 (gladstones) now at money claim stage

First off, I have recently had a parking fine from February this year cancelled with the help of this forum, thank you!

This thread relates to a fine from 2023, Tesco car park, (horizon) now being pursued by Gladstones. I appealed at the time, it was rejected, naively I didn’t appeal to POPLA as I thought it would just go away. I didn’t have the help of this forum then.

I have already stated I was the driver in my original appeal to Horizon, it was a lease vehicle and I now realise a copy of my lease was not sent to me with the PCN.

I have skim read parts of the newbie thread for MCOL, in a nutshell in my position do I have any defence?

Why do you say it's "at court"?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I have just received the money claim paperwork, sent from the county court, sorry if the thread title is ambiguous.

Am I going mad or is there a glaring error on this form?

    Brilliant!

There isn't even a Particulars of Claim! And no money claimed at all.

If this was me, I'd go straight to Contestor Legal with that and ask to use their no win no fee claim strike out service.

Get it kicked into touch and cost Gladstones the fees!

    Thanks.

Why is the amount claimed zero? Is this a court error or gladstones?

You also state no particulars of claim? It is listed but should this be more detailed or laid out differently, I’m confused? Also the fact they state £80 and £70, could this still cover them or is the ‘total amount £35’ the key point?

No county court is involved here, just a civil service office in Northampton,  the CNBC , a government department centre for issuing claims  ( the county court in Northampton has a different address,  but county courts don't issue money claims  )

Don't overthink this, the details that should be in there are not there,  regardless of who made the error  ( most likely to be a Gladstones error   ), who cares about the minutia  ?

No need to be confused,  look at other pictures on here and play spot the difference , then use their errors to give them a bloody nose, hit them in their incompetent pockets or wallets

Then do what coupon mad suggested because Contestor legal will know, will understand and will have a field day

Sometimes you don't need to know, but to exploit others mistakes

    Many thanks, all noted.

On a side note, where that document uses the count court stamp, I presume they can still actually issue a CCJ that is enforceable?

I only ask as I just completed a money claim against an organisation on another matter, and was awarded a judgement by default, I now need to enforce this, it was all through a court address in Northampton, I’m concerned now about what sort of judgement I got?

    1) On a side note, where that document uses the count court stamp, I presume they can still actually issue a CCJ that is enforceable?

    1) if a court claim is issued via MCOL and not defended by day 19 following its issue date,  the claimant is free to press the button and seek judgment.   This would be classed as a default CCJ,  due to being undefended , which I assume is your current position

I dont know their procedures,  but they do refer them to a judge so presumably they have them on retainer somewhere,  perhaps in an office there   ? Perhaps via the nearby county court   ?  Definitely some system in place

The fact that court stamps are used could be a nod to the past,  an official stamp that hasn't been updated   ?  Historic  ? I dont see why it matters,  the system has been centralised in Northampton,  a one stop shop  ( Salford was retired over a year ago   )

A CCJ is definitely enforceable,  via the systems already in place,  such as A warrant of control,  if it remained unpaid after 30 days,  which I assume means that the default CCJ occurred and is currently unpaid,  hence why you can chase it up and follow the MCOL enforcement advice

If your adversary had defended the case,  eventually it would have been transferred to a civil county court for a hearing,  where a judge would decide and issue a judgment

You received a default Judgment if it was undefended

Your claim form was issued on 16th April 2025

Lastly,  I suggest that you alter the thread title to something more suitable because the claim is not at the county court stage yet,  so something like

Claimant name,  lawyers name,  court claim 2025

The names are under the redactions in the 2 boxes on the top left of the claim form

Just get on to CL quickly as the application to strike out needs to be done straight away.

That claim is a mistake by Gladstones and needs a strike out (which will cost them).
