  • I hear what you are saying. Sorry, I am having a really bad day. I have a discharge meeting for my brother on Monday and he has been set up to fail. They want him in a care home. I will digest what you are saying and think about it. 
  • I have read the form and I don't think they will say I can't manage money. 
    My partner runs his own business, we barely scrape by, and he is uncomfortable with me going down a CCJ route. The card is not even 5 years old, so nowhere close to statute barred. I shouldn't have left this. I feel so stupid 😪

    I understand your reluctance to share personal details with vultures like Kearns, especially with what you have going on elsewhere in your life, but as they are unaware of your personal circumstances, they will keep pressing ahead with this as they have no reason not too.

    A simple letter outlining your current situation, and how its effecting you, should put matters on hold.

    If they know there are problems in your life, a CCJ can be avoided, otherwise the system will just kick in and you will likely get one anyway.

    There is no reason why they will not accept an affordable payment plan, and given your circumstances, it would be one less issue to worry about.

  • Thank you. I was actually thinking of doing this because I have disability and health issues, which I did share with the original creditor. 
    Can I send a letter as an email over the weekend and follow it up via snail mail? 
    I actually paid 3 months of the original agreement before it was sold on. All on time.
    Will post up a copy of what I send to this thread.
  • Can I send a Notice of Vulnerability to Kearns and Link Financial to stop them going down the court route so I can deal with Link directly, please? Of is it just for bailiffs?

    Yes of course you can, its for any creditor, ask them to return the account to Link, and give them your reasons.

    I have actually sent a letter explaining my issues and asking to return it to the original creditor. I am happy to follow up with a stock Notice of Vulnerability if you feel that would help?
