    Yes. SEND TODAY
Sent and thank you. Let's see if they find something.
  • Arrived and signed for.
  • Have heard back from Kearns. See attached photo. They want me to contact them by Christmas Eve.
Actually do not know what to do as I am on disability benefits.
They have sent an agreement with a typed signature of mine and signed by a Vanquis person, the assignment letters and a printout of my card statements.
I have so much going on at the moment, including my brother with dementia, in hospital, that I am deeply depressed.
I am so angry I came to an agreement with Vanquis after explaining my situation. I paid my first month and it got sent to Lowell.
Guess there is nothing I can do. I am in tears with all this.
  • OK Stop worrying and if you can't afford to pay your unsecured debts then stop paying them.

Nothing terrible will happen, hang on until you have sorted everything else out.

Have you contacted your GP about your depression? There is a Mental Health form you can get signed to stop you being chased.
If you go down to the woods today you better not go alone.
  • Yes I have spoken with my GP and currently have counselling. Kearns have already got me to precourt stage, see previous posts. Happy to attempt to pay it off but I don't know where to start. I cannot afford much and I do resent that they probably only paid a small amount and they make a hefty profit. It's only just over £1k but I feel very overwhelmed by it all.
  • This is the link to the form you need completing.

Debt and Mental Health Evidence Form. StepChange

Do not pay Kearns, they are trying to frighten you into paying, what is the worse that could happen if you don't pay?

    Take me to court.
I just looked at the form and I am not sure I am comfortable with it. I have been on disability benefits for years. I am in my middle 50's. I own nothing. What little credit rating I have built up is going to be lost. There is no lump sum.
I explained to Vanquis I am caring for my senior dog and the meds and insurance have, over several years eaten into my little spare money. They said they fully understood, would pause everything and I agreed to £25 a month at that time. I paid 1 month and they sold it before the next payment was due. I probably should have continued to pay Link, but I was so angry as I felt Vanquis welched on our agreement.
Can I come to an agreement with Link?
  • Please get this into your mind. Do not pay Kearns

If they are thinking of applying for a CCJ they don't just magic it up out of thin air  they have to go through a legal procedure which starts with sending you a letter by snail mail where you have the opportunity to defend and explain your financial situation. So if the worse came to the worse you could get a CCJ for £1 per month.

That mental health form is the way forward, your doctor can't charge you for filling it in if you live in England and it will be accepted by your creditors.
If you go down to the woods today you better not go alone.
  • But I don't want a CCJ.
    No, I won't pay Kearns.
These people do not need to know my mental health situation. None of their business. Dr is pretty useless to be fair. My NHS councillor will probably charge.
  • Look it is up to you if you don't want to get the form filled in but it is to your advantage, your councillor can't charge either.

What problems would a CCJ cause for you? I guess you won't be looking to take out more credit, you don't work in a job in finance so no problems.

No one can force you to do anything but you do need the mindset that you are in charge not your creditors and therefore you should be prepared to do what you can to get the debts reduced or written off which they can do with the mental health form.
If you go down to the woods today you better not go alone.
