Black Horse Car Finance

We have a settled car finance account however we have discovered via a mortgage application last week that BH listed a default on our account on 12th November, our car was collected on the 14th October we had a balance provided to us of what we owed prior to the car being collected but we were under the impression that we needed to wait for the inspection to confirm if there were any damages to pay. We never received any confirmation from black horse of final balance, they just placed a default on our account. They have said to me today when I queried why was I not provided with a default notice prior to the default being listed they said it was because we VT our agreement and they don’t have to, then they changed it to say we did send you a letter on the 12th Nov (which we never received) but my understanding of the default notice is to provide us with notice to remedy the debt owing, they also said to us that we knew what we owed and yes we did before the car was collected, they said they don’t charge for damage “they have even collected cars without engines” which we than said why were we requested to return the car in good condition ? What is the point of the inspection. I have checked the BH VT guidance and they haven’t complied with their own guidance. They are refusing to remove the default as they believe they have followed due process, I do not think they have. Any feedback would be gratefully received

    I thought with BH, part of the VT is that you pay any balance due within 30 days.  Payment for damage is a separate issue.

    You can ask the credit reference agencies to put a comment from you against that entry on your file.  I don't suppose that will make any difference to anything.
    You can make a formal complaint to Black Horse.  If they don't resolve it, then you can go to the financial ombudsman.
    If it sticks, force it.
    If it breaks, well it wasn't working right anyway.
  • I think they have not complied with the fact that they cannot default your account the same day they allegedly issued a default notice, they have to provide you with 14 days before an actual default is registered. We have formally complained they have 5 days to acknowledge they are day three!
