euro carparks and DCBL have taken me to court for ticket

Old post i had to make my own thread

I have just received court papers from DCBL for euro car parks because my car was in need of water at a garage and i spend a few minutes to long and received a ticket. I was only there too long because the garages water machine was broken and they didn't have a watering can so i had to buy bottles of water.

First of all i defended my 1st court letter but they have taken it farther now i have received a N180 A COURT DIRECTIONS FORM. If you believe that DCBL wont take you to court i must be 1 of the unlucky ones. The only thing thats concerned me is the letters with "can't pay we will take away" logos on letters. I feel they are even dramatizing the fact they were on tv etc. I will continue to fight this as i feel £170 for 10mins extra in a carpark is stupid and unjust

OK, they will send you a hearing date,  plus directions and deadlines  ( the claimant parking company via their lawyers will get a copy too  )

The WS stage should be before the hearing date,  that is the time when DCB Legal will probably discontinue, like all the rest in the thread by Umkomaas

    Does this thread: -

relate to the same issue?  Always best to continue on one thread so we don't have to keep dodging about the forum trying to find connected threads.

I received a letter today from the courts asking for witness statements etc and has to be filed by 6th 2025.Also a couple of hours ago i received an email from DCBL reducing the fine to £60 if i pay within 14days. Please see below the email i received.

    Good Afternoon,

WITHOUT PREJUDICE SAVE AS TO COSTS

We write in respect to the above Claim and shall shortly be sending to you our Client's Witness Statement together with all documents in support of their Claim against you. This evidence will be presented at Trial, and we are confident that your liability for repayment of the Parking Charge will be determined by the Court.

Despite this, we have been instructed to attempt to settle the case with you so that the matter can be brought to an early conclusion and in order that you may avoid a County Court Judgment (CCJ) being granted against you, should the Court award this in our Client's favour.  They are therefore willing to settle the case at this stage for a reduced sum of £60.00. Should you be agreeable to the same, please ensure payment is made within 14 days of this email.

If payment in the above sum is not made within 14 days, we have instructions to proceed to Trial, where a CCJ could be granted against you. A CCJ can remain on your credit file for 6 years from the date it is granted, and its impact may make it difficult for you to obtain credit in the future, such as a mortgage.

Once paid we shall inform the Court of the early settlement, requesting the Trial be vacated and the Claim marked as paid. We shall then close our file.

The benefits to you making a payment to settle the Claim at this stage are:

    • Avoid the case proceeding to Trial where you may have to attend.
    • Avoid the risk of a CCJ being granted against you and the impact this could have on your credit file.
    • Avoid the risk of further fees and costs being added to the amount you owe should the Claim proceed.

You can make your payment to settle this Claim by using one of the easy payment methods below:

Please ensure you quote XXXXXXXXXXX with any payment.

    Morning guys,

I received this email this morning. Many thanks for all your advice.

We act for the Claimant in the above matter.

Our client has instructed us to discontinue Court proceedings and close our file. Therefore, please find enclosed the Claimant’s N279 Notice of Discontinuance for your records.

The attached has also been filed with the Court.

We will now proceed to close our file accordingly.

    Kind Regards,

    Yay! You won - congrats!

    ANOTHER ONE BITES THE DUST!

Please stand up and be counted by showing us the actual NoD, so that @Umkomaas can count your success in the disco thread.
