Letter of Claim (BW Legal)


I have now received the Letter of Claim, and will be using your template to reply, but wondered if it was worth adding a point 3 to it as follows :-
Your client is fully aware that I was entitled to park in the space. I had purchased and paid for holiday accommodation at the resort and was in possession of a permit to park in the space provided, therefore this “invoice” has no substance as I received no service or goods from your client. The role of Armtrac services (KBT Cornwall) is to ensure people who are not entitled to park there are invoiced, not chase after legitimate drivers to try and make a fast buck.
For reference they are chasing me for not displaying the permit correctly for a period of about 45 minutes. This was on the 3rd day of my holiday and was the first time I had gone out in the car, come back and forgotten to display the permit

I sent it to disputesolutions at bwlegal.co.uk and havnt had it bounce back but also not 100% they will get it as the try and force you to use their online portal.
Is it worth copying the content of the email and sending that via the portal or do you recommend def not using their portal?
My big concern is not having any proof I have sent a reply if just the portal is used.0 -
Your choice, as long as you dont answer leading questions, dont ask for proof etc, dont add any stories either, less is more, like No Comment interviews

Have had an email reply from BWLegal as follows. Do I just keep waiting it out for now?
"It is the overriding objective of the courts for parties to settle matters amicably without the need for a formal hearing. This includes raising any disputes and concerns with either party, prior to the issue of a County Court claim, to ensure court time is not wasted and additional costs are not incurred unnecessarily.
A PCN is not subject to VAT as it is not an invoice. A PCN is a reminder of your contractual obligations to adhere to the terms and conditions of parking and notification that these terms have been breached due to no permit.
Please note that this is in regards to breaching the terms and conditions of the site not damages.
Whilst we note your comments, our Client clearly stated on the Notice to Keeper/PCN that should this PCN remain unpaid for a period of 28 days, debt recovery agents may be instructed and additional costs incurred. As a result, our Client is satisfied you are liable for these additional costs and will continue to pursue you for the outstanding balance.
This matter has been placed on hold for 30 days."

Well, you could report them to HMRC with possible VAT concerns, same as many others here have done
Then wait for a possible court claim pack to arrive within the next few months1 -
When you get replies from such idiots please don't post them here like they are new & different!
