Parking eye appeal 3 days left

Hi, 

I have not posted about this parking charge  before.
 I sent an appeal but they said they need the name of the keeper and if I don't tell them then I am liable. I have searched other threads and seen a template that says the signs are illegible and then it mentions about the land not owning to them.

In my appeal I used the template but adjusted it as 'the driver' did try to pay for parking via phone, Online and then by going to the church of whose car park it was, realising that they couldn't pay they left, they are trying to charge me the keeper for my car being there 10 minutes even though I supplied evidence of the web page not working and the call history to pay for parking.

Because I have used this in the appeal I can't use the signs illegible reason. I am hoping to go to POPLA maybe that would help but I have 3 days left to send them further info. I can't find out who land owner is and the church seems to be not in function anymore. 

Should I just use the template about they are not landowners? And request a POPLA code?

    I doubt that they asked you for keeper details,  more likely they asked you the keeper for driver details  !

    Clearly the driver could not complete the parking contract so left promptly,  but presumably not quickly enough for Parking Eye,  so 10 minutes on site

    Sorry I meant to say driver, this is the letter but I just want to know is sending the template useful enough, as I mentioned before I have already said they tried to pay so I can't now say the signs are illegible and all that?
    Am I able to say that bit about the parking charge outweighs the 'crime'? Can't remember it off top of my head but I didn't write in in my initial appeal.

    Sit on your hands and wait it out,  after which they will contact you with either a rejection and popla code,  or a cancellation

    Oh I thought to get a rejection or something I would need to reply to this letter? I haven't contacted them since this letter.

    A few other threads I have read, the people have replied to this letter.

    You think I would win at POPLA? Literally tried to pay. Couldn't and so driver left, ridiculous they ignored it and just want driver details.

    Sit it out, no replying,  not yet anyway,  they should let you know something after the self imposed deadline 

    Popla is a lottery,  so I wont predict anything about chances

    Sometimes appeal reply ends up in your junk mail so keep checking there too until it's received.

    Hi, so my POPLA appeal got rejected (I have added it to the thread) 

    I have received a claim form and have completed the AOS, the claim form was dated 22.09.25 so i believe I have until the 25th to submit my defense. I have just written it so wondering if someone can check and should I add about parking eye not being a landowner- need to provide evidence or can I not add that now as I did not put it in my POPLA appeal, I honestly thought they would see that I did not use the car park and uphold my appeal but they didn't.

    I did find a good post a bit ago about using a car park for 10 minutes and grace time that I was gutted I didn't see before sending my appeal to POPLA, I am hoping to use it for my defense but I can not find it just now so I will keep looking but wondering if what i have is ok and should I edit paragraph 1 in the defense about they have not been specific as they have stated what my breach is.

    also on paragraph 2 it mentions the charge being over £100 well mine was £100 before the court claims so should I delete that part out or is it about the fees the court has added on.

    3.The parking operator’s signage within the site state: “For use by Stockport Elim Church patrons only between Mon – Fri 8am to 6pm – tariff applies outside of these times Parking tariff applies Mon – Fri 6pm to 8am, Sat & Sun 12am to 12 pm”, and if these terms and conditions are not met a charge of £100 will be issued.

    The above is the claim by the parking operator., the sign at the entrance of the site was not visible as I drove down the road, as the sign is side on and not visible, it would only be visible if standing opposite of the car park. The signs in the car park, which are the ones I read did not state the times of the carpark which is only for permit holders, the signs are ambiguous and it is hard to ascertain whether anyone or only permit holders can park which is why i proceeded to try to pay online, vis phone and then lastly walking to the church to get some clarity, I also talked to another would be patron who also wanted to park, with whom i had a discussion with and accompanied me to the church, they were the passenger so their driver got to leave the car park but I was the only person so that is why I was in the car park. I think it is clear from my evidence that I tried to pay and were only there for 10 minutes, I did not use the car park, I tried to pay numerous ways and left when I couldn’t and therefore the parking charge is unsubstantiated, there should be reasonable time to re-read ambiguous signage and pay via all these ways as there is no way to pay by cash or contactless.

    I have appealed and also appealed via POPLA but have been refused. I do not understand how I can be charged £10 per minute for trying to pay, especially when I did not use the car park for any other purpose than to pay the parking operator

    I have added the bit about not being compliant with BPA CoP..

    I think it is clear from my evidence that I tried to pay and were only there for 10 minutes, I did not use the car park, I tried to pay numerous ways and left when I couldn’t pay, by receiving this charge it is clear that it is not compliant with clause 13 of the BPA’s code of practice, I was not allowed reasonable time to read,re-read ambiguous signage and pay via all the aforementioned ways, which i have timestamped evidence for, as there is no way to pay by cash or contactless.
