Well now i DO have a CCJ.

I'm currently working at sea so limited communications ability in south america.
My friend that looks after my house has been picking up my post and on the 30th of April i have received a letter from the court stating that i have not replied to the claim form and so a judgment has been entered against me.

The letter is dated 25th April and says i have 1 month to pay it and the entry on my credit record will be removed.
Its already live and shows up on both of my credit reference agencies.

So i need some advice on what to do.

I sent the defence document well within the timeframe and i have the email receipt to say it was sent. But i never got any further confirmation that they had done anything with it. I even phoned up to confirm if they had received it and was told that they are backed up and it can be up to 6 weeks before they process anything.

    So what do it do?

The letter says that if i believe it has been entered wrongly in default that i can apply and state my reason why the judgment should be set aside and there is a form and a fee available (but doesn't give any links or information on what form and where to get it from)

If i ask to have it set aside and state that the form was replied to and give the evidence that the email was sent and received, will they review the defence of the claim ? or is it a done and dusted?

If i am able to get the judgment set aside, will it still show on my credit report and dent it?

Or should i just pay the DCB Legal thieves and take the hit in the pocket?

Can i pay the debt and in the meantime ask to have the judgment set aside? or does paying the debt fully acknowledge it and close the matter?

I would be very grateful of any advice anyone can offer. As i have said, i'm currently at sea and have a limited satellite internet connection - I get to use a whole 66mb a day before the system cuts you off - so i dont have the ability to go trawling the internet, all the adverts and spam on websites soon eats up your data just loading pages up...

    Thank you in advance

Email a complaint to the CNBC immediately and attach the email receipt as proof that you did defend on time. Their error; they will set the CCJ aside at no cost to you.

As above, there have been dozens of these typical failures at the CNBC in the last 5 months

    Thank you for your advice.
I emailed a complaint to the CNBC but have had no reply and as they have already failed at processing received documents i don't hold out much hope in them being quick off the mark to fix this either.

I have had to ask someone to pay the judgment for me as my ability to do anything for the next month is limited until i get home and the deadline to pay is the 25th ( CCJ issued on 25th April ) as i don't particularly want a 6 year crimp to be on my credit report.

If they do set it aside i can claim the charge back.
If they don't set it aside then at least i have off set the credit crimping.

    Nononono!

    STOP THAT PERSON!

You do not pay it. You'll never get the money back. DO NOT PAY IT. Tell them to stop now.

Just email a complaint to HMCTS. It'll be sorted this month.
