You won't be "handed" a CCJ.  The judge might side with CEL and make a judgment that you owe them £x, but that is highly unlikely since CEL usually have dodgy contracts in a different company name.

Provided the judgment amount is paid within 30 days then the CCJ will be removed from the permanent record as if it never existed.

Also, how did 3 PCNs reach £1700?  £170 * 3 plus court and legal fees should still be well under half that amount.

Always remember to abide by Space Corps Directive 39436175880932/B:
'All nations attending the conference are only allocated one parking space.'

"Claim value is now for over £1700"

No isn't! Did the Mediator mislead you?

  • I am aware I have 30 days to settle without a CCJ staying on file but the thought of paying £1700 is infuriating.

The mediator was very pushy and insistent I should settle prior to court, so much so I asked if he was impartial or on the side of DCB!

What are your thoughts on the claim as it stands? Am I in a strong position or is it down to how the judge feels on the day?

The POC claimed £510, Plus legal and court fees,  definitely not £1700 ; more likely to be £700,  I think that you added a typo.   3 times £100 a time pcns is £300 , plus legal and court fees

CEL are using DCB Legal according to page 1, they appararently offered to settle at £250, so it seems to me that they will discontinue before the hearing fee is due to be paid

I bet Sarah Ensall signed the claim,  so your WS bundle should take account of the recent Mazur case too

Phone the court on Thursday of Friday and check if the hearing fee was paid,  or not

Civil enforcements witness statement landed this morning via email so they are intending on going all the way. What is the protocol moving forward? Is there a way of attaching the document to the thread so you have an idea what I am up against?

No need, we really don't need to see these. Read the other Scott Wilson one posted today. It's a template.

Note that the claim is entirely based on an alleged contract.

You have never seen this contract and neither has the judge. The signage should be Exhibit 1 in the Claimant's bundle.

    Where is it?

So you found the other three posts at the exact same stage as you then? You were one of four posting the same thing yesterday about CEL.

You could have just searched the forum for his name snd changed the results to show NEWEST.
