Moorside Parking ticket - small claims track

You should log in to your MCOL page and check the status, you might already have a judgment on default.2

"… in a nutshell, Moorside have emailed me saying they intend to press ahead to court, and I have received a proposed allocation to small claims track."
Sounds like your defence has been accepted.
But show us a photo of the last letter you received from the court (remove any personal details).2 -
Defence isn't terrible, it's just missing all the legal stuff. you can shoehorn that into your witness statement, so don't worry.
"After a short amount of time, I realised that the business was in fact closed for the day, and exited the car park."
So, unclear signage and even if you had seen and read the signage the effect is no different from declining the contract and leaving.
I would just have a good think about how long you waited. I'm sure it was only a very short time - 2 or 3 minutes perhaps.3 -
Absolutely not and highly unlikely.b12esa said:
I understand that now, and this being my first time dealing with anything like this, my concern was more to ascertain if there any likely scenario I will succeed post issuing my very poor defence, or do I just concede I’ll be paying out?ChirpyChicken said:It's a very poor defence.
You have limited your arguments to 'poor signage' but that is something that Judges like to get their teeth into and often wins.
And there's no risk (no huge costs or CCJ) as long as you do a decent WS with evidence and turn up at the hearing. That's assuming Moorside Legal don't discontinue.
Carry on. Go and get lots of photos of a lack of entrance sign and lack of prominent t&cs. You'll need lots of evidence in support of your defence.
At Mediation call stage, offer a tenner AT THE MOST, to cover the tariff, DVLA look-up £2.50 fee and postage of the PCN.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
