DCB Legal- HM Courts Claim

To start with, I have read the newbies posts, so am pretty sure what to do in my situation but I just want to clarify a few things before proceeding. 

Rightly or wrongly my wife ignored the original letters from DCB legal in regards a parking fine from a local retail park due to overstaying our welcome of about 15 minutes. They have now made a claim of monies owed to the courts against her (as pictured below). 

As per the newbie thread I will now launch a defense against this. 

My only concern is within the claim letter from the courts within the Registration of Judgements section, it states that "If this claim results in a judgement order against you, details will be entered in a public register..... They will then be passed to credit reference agencies...... THIS WILL MAKE IT DIFFICULT FOR YOU TO GET CREDIT."

I know what the newbie thread says, but I just want to clarify that if i appeal this, im not going to risk a CCJ against my wife for this?

    If that court claim was issued to your wife,  you do nothing at all, it's not your case 

    Too late for any appeals,  she defends it as the named defendant 

    No money is owed to the courts,  G24 via DCB Legal are claiming the amount on the claim form 

    No ccj is at risk if the Defendant follows the advice given here

    What a shame you didn't try PLAN A when the PCN first arrived. I don't mean 'appeal' by PLAN A. I mean, the retail park would have cancelled it in a nanosecond for you.

    Anyway you now have a claim. No worries!

    You are defending not 'appealing'. Although you might want to think if it as the ultimate, fair and impartial 'dispute resolution' that wasn't in offer before.

    And no, of course we don't put ANYONE at risk of a CCJ here and people file defences that are discussed on new threads several times a day.

    No CCJ is risked.

    You are certainly not alone and not at risk of it affecting your wife's credit rating, as long as she defends and follows all court letters/directions.

    It is a no-brainer for your wife (assuming she's the named Defendant?) to defend the claim. Dead easy as well. Literally copy and adapt any DCB Legal 2025 thread defence paragraph 3 (unless it's ParkingEye or Group Nexus which are slightly different at the start of the defence, as seen in the first post of the Template Defence thread).

    Which PPC?

    Any reason for the overstay? Elderly or disabled? Busy sales time? Or big shop and a busy car park with queues?

    When did your wife do the AOS?

    Show us the POC please.

  • Thanks for your reply @Coupon-mad . Apologies, for the delayed reply but my wife gave birth on Thursday and we have just left hospital. 

    My wife did the AOS last Wednesday. 

    I am trying to determine whether its a Parking Eye or Group Nexus car park, not sure how to find out short of driving to the car park. 

    The overstay was less than 15 minutes, the overstay was largely due to the fact that my wife was heavily pregnant whilst also travelling with our 2yr old son. 

    Sorry, what is the PPC? And the POC?

    PPC = Private Parking Company , in this case it's G24, not those other 2

    POC is Particulars of Claim,  lower left of the claim form 

    The claimant Parking company is shown on the top left of the claim form , G24

    But the claim form tells you who the Claimant is. Show us the POC please.

    5th March. Hope she's done the AOS? She's already a day late and risking a CCJ if not. This is easy and shown in pictures in the 'how to do the AOS' Dropbox link in the second post of the NEWBIES thread.

    Update: After completing the AOS and filing a defence based on the newbie thread in this forum, for DBS legal, they have written back to my wife on 16th May stating that they intend to proceed with the claim against her. She has now had a 'Notice of Proposed Allocation to the Small Claims Track' (Both letters pictured below). 

    The second document is asking her to fill out and complete a directions questionnaire, what are her next steps in fighting this (we had read previously that DBS Legal typically dont challenge a case if its defended, so she is now a little worried.

    Both of you should be reading, studying and following the 12 steps in the defence template thread in announcements,  please do so, because all these queries are answered by coupon mad in there 

    No need to be worried,  just trust in the steps,  the process and the advice   ( nothing to think about,  or worry about,  its a private dispute over money,  nothing else   )

    The Defendant seems to have abandoned the first 12 steps and by not following those, wasn't ready for these standard early stages. Please stay on track as per the first 12 steps in the Template Defence thread.
