SMI

i have been getting mortgage SMI since february 2008 My SMI is 180.58 they say based on a mortgage of 59,210 . My mortgage has never been 59,210 and never will be My mortgage is 102,000. I have disputed this when the original house was bought by cash there was no mortgage then the mortgage was taken out by my husbands partner at the time so anything to do with the remortgage with my husbands x partner should not have anyting to do with my claim for SMI Citizens advice claim that SMI is supposed to be reviewed anually on the original date that you took it out . I have never had an anual review on my SMI and neither has any of the people that i know claim this . SMI tells me they cant change anything as the original SMI team set it up and they cant change anything (So that would mean then if that is the case no review is possible if they cant change anything that it is set in stone ) I have migrated from Employment and support allowance SMI - to Universal credit . and believe that there was an original error when SMI set this up i did raise it with them 10 years ago and so did my mortgage company but it was brushed under the carpet the SMI team said if anybody can shed some light on this for me (I have now had to fill in an MI12 form so that they can look into this decission to overturn it /do manditory reconsideration .

    How much was the original mortgage for? 

    Did partner claim  SMI?

    What happened to get from partner having mortgage to you now having mortgage? 

    Did husband take over mortgage when partner became ex. 

    When did you take over mortgage?

    Just to check this is my understanding.

    • House was brought cash - no mortgage. 
    • Your husbands partner took out the mortgage (I assume to gain cash) 
    Then the following should be asked 

    • How Are you and your husband claiming SMI with no mortgage in your name.

    So is OP being assessed for SMI on the wrong mortgage on the wrong property?
    Is your mortgage on the property you live in?

    Or, did you buy the property off your partner's ex? Or, have you ported your mortgage to another property?

    I. Wonder if the husband  and the mortgage  were a constant on the UC claims.

    If it is the same house and mortgage, but mortgage was increased then I think only the original mortgage would be eligible for SMI. 

    Or  has  bought a  different house with new mortgage ?
